How are you sure that the "sneaking in" of our provisions with the 'undocument workers' provisions is going to alleviate our plight?.
Note that the staff to support this overhaul is not going to increase overnight. Consider this - 100 people (just a 'supposition' - this is not a hard number) are working on 500,000 applications today; With the passage of provisions for 'undocumented workers', the same staff of 100 is going to work on 11 million 500,000 applications, atleast for the next 1-2 years. Do you understand the mess that this will create? It will be a similar mess as the 'Labor backlog center', where the applications of 2003 are still waiting for their certifications.
Although I agree that we should work towards supporting the current provisions already in the bill, I still feel that issues such as 'I-485 application without PD current' and 'removal of hard country quota' are important, in order to ensure short-term reliefs. These provisions may not help your specific case, however it may help 1000s of other cases.
Just my opinion from the limited knowledge that I have of, how UCSIS operates!!!

I think you are wrong in stating that I do not grasp the issue that AILA is only interested in illegal immigration issue and not in EB3 retrogression. I know that more than you can imagine, which is why I have been urging the forum to stop asking every one to fax the senators with requests to remove hard limits by country or even concurrent filing of I145 when visa numbers are not current. I read on post by a junior member where that person DID GET A CALL BACK FROM ONE OF THE SENETORS OFFICE AND THAT GUY COULD NOT ARTICULATE THE ISSUE WHEN THE SENETOR ASKED HIM IF THE ISSUE WE ABOUT INCREASING H1-B’S.
Exactly what happens when thousands of people contact senators instead of one fax from one organization with one point of contact just so that if some one actually calls back from the senator’s office we at least have some one who could explain the situation in a way that makes sense?
Also, I know how difficult it could be to get an amendment in just as well as you and I also know the fact that the real interest is in solving the illegal immigrant’s issue. The reason for that is the issue that the U.S has is with ILLIGAL IMMIGRATION. The EB retrogression is really our problem, not some thing that is going to raise alarms in the senate. Anyone got their AP renewal approved? How long it is taking these days?
I applied for EAD and AP renewals concurrently on May 28th and sent following support docs for AP.
1. 2 photos.
2. old AP copy
3. I-485 copy
4. Passport biometric pages
5. EAD copy
FP appnt on June 23rd.
AP Approved e-mail on June 23rd.
My wife's Receipt was just 10 nos difference but she hasn't got it yet.

Thank you for all quick replies.
It's been about an year the case has been closed. I can't expunge it for 4 more years. The attorney said it may not be under CMT. I think even though we expunge it, in future where ever we go, if asked that ever got arrested, we need to say YES right?
My attorney says it should be OK.. I am not sure what to be done as you said it all depends on the VO

It is expected that demand will bring allocations up to the program limit during November. Once the limit is reached no further allocations will be possible, and the category listing will be removed from future cut-off date tables.
A PD for Schedule A category is for those people filing under EB2 with exceptional skills in arts and sciences . We had a post recently. Nurses and PT's do not have PD's as they do not have to file Labor Cert in the first place.

Will CIS generate the Receipt notice first before transfering the application to the appropriate service center. ( like transfering the application from NSC -> TSC when the I-140 was approved at TSC but filed at NSC)

6 months after GC is safer. The "6 months" is usually USCIS rough assumption for calculating "intent". Doest mean that you are absoulutely safe after 6 months. It doesnt mean that you are in danger before 6 months also.
You are supposed to have the "intent" to continue working for your GC employer AFTER getting your GC. The 6 months is to show that you HAD the intent, and after 6 months your intent changed.

Most people has very misconception about "parole". It is not a free/flexible travel document like visa. As a AOS applicant, one should not leave US till it is approved/denied. One MUST present in US during AOS. The parole is only for any emergency purpose; which is similar to prisioners. As USCIS is flexible, in approving the AP, the people don't realize the travel limitation of AP. They are travelling on AP for vatation/fun etc.. As per law, the AP is not intended for it. The CBP officer was right in asking the legitimacy of the travel. The AP document clearly says it is based on "humanitation" admission to retrun after an emergency travel.
Technically, you are right. But on the other hand, it was at a time when one had to wait at the most 6 months for AOS.
But, for people from India, on EB categories, the wait is not months, its in YEARS. So, its irrational to go by whats written there.
On the other hand: I think we must request USCIS to recognize this underlying problem with EB folks that are primarily from India. They must print an exception on the AP for India and exclude the wording "for emergency purpose only". I don't know if USCIS has the discretionary power to amend minor changes.

Interesting experiment, and I can see that is how human beings respond sometimes.
However we are guaranteed something in return when we TRY to do what we believe in, regardless of the odds as we see them: the satisfaction of DOING something about it, and a real shot at getting what we want.
Easy to try it. Pick anything, literally anything about your life you want to change (from changing your job to losing weight to calling up your parents more frequently).
Then WITHOUT THE FEAR OF FAILURE, do something about it. It will either work out, which will be terrific. Or it won't... maybe you don't success at that job interview after all, or you still put on weight. Even then, the satisfaction that comes from having TRIED is yours to keep! (Personally, I have found this to be more motivating for trying those things again, as opposed to the hopelessness that results from not trying and then seeing things not improve.) And of course, since failure is only one of two possibilities that there can be, you do succeed 50% of the times that you try honestly!
In case of IV's efforts including the upcoming Advocacy Day, that is exactly how I feel.

The guys from Freakonomics did an experiment in a Chicago school. They said they will give $50 to all students who will get a B or higher in all their subjects. After some time they have found out that students who were getting a grade in the vicinity of B earlier have improved their grades to B level. But the students who were already well below B, actually went down in the grading; from D to E for example. You can google for the details.
In the GC saga, what we need is a B grade or above.
EB3 Mexico already has a C grade, hence he tries hard to improve himself to a B grade.
EB3I is in D grade. We more or less feel that trying hard is a waste of our time. If we try hard, we might get a C grade (means EB2I folks will get GCs :( :( ). The end result is that we go from D to E. That is what you are really seeing.
PS: despite the above generalization, I am planning to participate in the advocacy days in DC and I have already contributed to the efforts. Because human beings defy logic and what is natural to other life forms on earth.

Sept dates may advance and some lucky ones are sure to benefit --but for their attempt to use the remainder of visa #s in fiscal year09. Now since most cases are pre-adjudicated hopefully they won't pick up randomly
If we do not see many approvals in August I am sure Sept will open floodgates similar to what we say in July 2008 when so many 2006 apps got GC.
