From the same memorandum:
"Accordingly, if the employer withdraws the approved Form I-140 on or after the date that the Form I-485 has been pending 180 days, the approved Form I-140 shall remain valid under the provisions of �106(c) of AC21. It is expected that the alien will have submitted evidence to the office having jurisdiction over the pending Form I-485 that the new offer of employment is in the same or similar occupational classification as the offer of employment for which the petition was filed. Accordingly, if the underlying approved Form I-140 is withdrawn, and the alien has not submitted evidence of a new qualifying offer of employment, the adjudicating officer must issue a Notice of Intent to Deny the pending Form I-485. Basically they want to prevent offshoring legally... meaning
if microsoft wants job done.. hire locally.. or bring people on direct H1 so they net the taxes. or do the job overseas.
If Infosys brings people - do not let them work in CIsco, microsoft or, HP... that way they put overseas company OUT OF Business

Please remember to ask your other H1B friends to sign up and convince them to contribute. One person can only contribute so much but one can always ask co-workers and friends to sign up. Even those who are in their 2nd or 3rd year of H1 and have just started GC should be considered as people who will benefit from this effort. They may not realize it now, but sooner or later they would.
Download the flyer from "Resources" menu and spend an afternoon outside local indian temple or indian grocery store. Ask people to take a copy and politely say "this is for information...I am not selling you anything" -- so that they dont discard it away and at least read it. Many of people either dont know about retrogression or dont know about immigration voice that is acting to curb retrogression and labor backlogs. Out of 500,000, if we can reach 10%, its still 50,000. With 50,000 members, the possibilites of what we can achieve is sending 10,000 volts thru my spine.

Obviously i was wanting to know what the law states...and not a democratic answer. I dont always expect forums to quote the law correctly - use your judgement!

I agree with most of the posts here ..there have been lot of ideas but everyone needs to be more serious ...IV core has to come up with a new campaign. ultimately the question is do we wait for something to happen or do we try for make things happen ..

(also Obama is not going to do anything on his own so soon as he has major major problems to solve first)
ofcourse Core has to endorse such a campaign ..if someone has better idea ..please share ..don't be an idiot and offer only criticism to other people's idea unless u have something better !!

We can use this time to strengthen IV as an organization. We need to prepare for war (activism) when there is peace (downtime). I agree with Pappu, we need to spread the word of IV as much as possible. I've to go beyond my friend's circle as most of them have a GC in hand! :D

People with grown up kids, I guess would prefer Canada over India. There are many problems starting with the education system, reservations etc. For kids who had been studying here from KG through grade 8-9 it's difficult to get dragged in the rat race in India, especially for normal kids who don't belong to any reservation category.
Yes in Canada we know that finding a job is going to be difficult and we should brain-storm about how to tackle this problem?
What skillsets are in demand? Anybody has idea?
I also have a wild idea like US companies may look at Canada as a outsourcing destination if given very competitive package. One of the biggest advantage will be proximity to the US, so better control over quality etc. That may not turn into a big boom but is a possibility.
My company has offices in both canada(toronto and vancouver) and US .. i have worked for extended periods of time in canada. I agree that career development oppourtunities are limited due to economic reasons, but I there is no way toronto or vancouver can be considered "racist". And talking of high skilled workers, who said there is absolutely no discrimination in the US ? Isnt that what programmers guild and other labor unions are all about ? how come so many people support the blue collar illegal aliens (mostly meat-packers and lettuce pickers), but nobody cares about us, tax-paying, law-abiding highly skilled people ?
The difference is at least the canadian immigration policy doesnt institutionalize the discrimination by making us wait in limbo forever, unlike the US laws. At the end of the day, I would rather live with "limited career development" opportunity in canada and change employers at will than be surrounded by plenty of such opportunity but have my hands tied behind my back by the US laws.

I have sent another email to the editor. Although they have provided an "Amplification" section under this article that says that the item wasn’t intended to imply high-skilled workers are illegal immigrants, the paragraph in which they report the poll result on illegal immigration went under the bold heading "High-Tech Employers". They should either correct this paragraph to exclude any mention of illegal immigration or change the bold heading to a more appropriate general heading on immigration issues.

I have many times pondered on the strength/power of dollar value and I feel apart from factors like globalization/petro dollars most important factor is America's politics.
No matter who is in the White House, no matter what their domestic politics are, no matter what their agreement(s)/disagreement(s) are they follow a well established strategic template on the International arena always keeping their focus on fortifying their super power status/dollar strength.
Very fact that dollar value is not as low as it should be amidst the current crisis shows the value that dollar is enjoying(when compared to the value of the currencies of other economies that didn't actually collapse as did American economy) may not be the real value but a strategised value.
Watch this video on globalization (if you have not already watched as it was shared on this forum twice) though it's a bit long and seems like exaggeration at few spots(speaker himself says he may be exaggerating or something like that..) it helps one understand few things.

My wife does not ahve paystubs from Oct 06 to Dec 06 and no W2 for year 2006. SO I would need a absence letter. Any for mat of letter would be appreciated.
We have paystubs from jan 07 to Jun 07 and plan to leave in July after filing 485 and plan to re enter in August using unexpired H4 visa.
I know of someone who used unexpired H4 visa inspite of being on H1 before leaving US
Any issues with above scenario?

The people who wants to be a part of American Society should first definately be a very open minded towards all cultures and social trends.
Other thing to be Indian or representing Indian traditions is not a crime but certainly every time barking against anything Indian may certainly be a crime as it is a clear indication of closed door or prejudicial mind towards one particular country and culture. Americans do not mind if one shows that he is Indian now and want to become in American future. Although they prefer that AND that is why they label Jindal as Indian-American although he born in USA. If there are majority Indians on IV board, it is not a crime but it is obvious. Some of my chienese friends on IV board may start thread for wishing chienese festival, I bet most Indians on this board will welcome and same goes with Muslim friends on IV board. Starting and wishing EID MUBARAK thread (By the way that is also a Indian tradition..And I am proud of that too) is not a crime and by now if nobody started it does not mean other people may not welcome it. If you are a Muslim, start the thread for EID Mubarak, I will be the first to welcome that step. You want to be American,, right? Starting and wishing EID MUBARAK thread (By the way that is also a Indian tradition..And I am proud of that too) is not a crime and by now if nobody started it does not mean other people may not welcome it. If you are a Muslim, start the thread for EID Mubarak, I will be the first to welcome that step. You want to be American,, right? Then first start learning open mind and start respecting the culture of majority IV memebers first. If you would not start that now how will you settle yourself in cultural pot of the world?
If you are an Indian citizen right now take control over your inferiority complex and get over it because if you do not respect your culture or your tradition what guaranty would be there for Americans that you would respect American traditions in future. Even Americans are not fool. And how dare you pretend that people form China and other countries just stop supporting IV as they just see few threads celebrating Indian culture? So stop this bullshit now otherwise I may have to request moderators to ban you.
