I think BPC and new case PERM is same, if it is same position then employer has to withdraw the first case as of DOL new FAQ, if it different position then shouldn't have to withdraw the case, possibly audited by the DOL as of above explained rule..... If the case is audited how long it usually take DOL to decide,

The mystery is solved. I have corresponded with Charlie Oppenheim in the Visa Office. He confirmed that the 27% limit does apply. He explained that during this fiscal year, the CIS consumed an unusually large number of Indian EB2 visas, thus making the category unavailable despite a retrogression in the cuoff date which was intended to hold number use within the limit.
He said that based on his discussions with the CIS, he was informed that the CIS did not feel that the current amount of pending Indian first preference demand would be insufficient to use all available numbers under the limit. Therefore, he allowed some of those numbers to fall down into Indian second preference.
So, the Indian second preference numbers used to establish a cutoff date for April are coming from left over Indian first preference, not worldwide numbers.

GC is an extension of H1B issued for 10 years and gives freedom to change the employer. Citizenship is different and do not compare GC with Citizenship.
That's not correct. There is big difference between h1B annd GC and it is not for 10 years. it is for ever unless you don't fulfill some conditions.

USCIS keeps on changing definition of Backlog as per their convenience.
They should clearly tell how many cases in which category and which county are pending.
We don't need complicated Backlog definitions such as below. Just be transparent and give us Black and White figures as to ascertain where some one stands in line. They may have their internal targets but we need to know BACKLOG from our point of view not USCIS production point of view
The new definition in quantifies the backlog by basing the figure on the number of receipts during the previous number of months that corresponds with target cycle time (usually six) and the current pending count for a given application type. This calculated amount can then be used to assess and determine concrete production targets for backlogged application types and the resources necessary to meet those targets. Therefore, backlog is defined as the difference between pending and receipts for the number of months of target cycle time. (Backlog = Pending – Last Six Months’ receipts). This new definition of backlog better reflects the idea that as long as USCIS is processing its receipts within the designated target cycle time, there is no backlog for those applications as the pending count only reflects cases within [USCIS] target cycle time.

after filing for I-485 on Jun 1. Also filing for EAD for self and 3 family members. EB3 Nov 2001. H1B stamped in visa valid till Oct 2008.

YES, I am. Exactly same situation and did a lot of research. There is a good new for you man.
As far as I know, you can file for AOS and leave. Make sure when your application get's to USCIS you are here in US, after that you are free to go. You do not need to wait for the reciept. Future action items might include drafting documents and letters to support this provision. There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.
The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.

No forward movement in EB2 (I or C).
EB3 is "Unavailable" for all countries of chargebility.
Where did the visas go this? Who got them that they are already out of them??
I have been wondering the same thing. Where did all the visas go? Some statistics on CIS website did not seem to indicate that many EB numbers were used last year. So weird!!! :confused:
Maybe as someone said, they just did not want to work. If they make visas unavailable, no case would be counted in the backlog queue and they will therefore meet their "blacklog reduction" target as published earlier???
Bottomline, looks like the new adminstration is no better than the old one to legal EB immigrants, although they have suspended raid on illegals. This is just getting better and better. :rolleyes:

there was a rencent drive undertaken by IV which involved getting a list from USCIS (or some other authority) about where the visa #s are being used, right ?
Perhaps something to do with collecting money from the requstor..
Basically, USCIS sent letters to a few folks asking them to pay 5000$ or so to get the list as it involved some programming ?
Where is that ? does anyone know ?

Hi All,
I m currently in USA on H4 visa, filed for h1b this year and got approved. My question is do i need to go out of USA and get it stamped first and then work here. Or can i work from October 2007 and then get it stamped whenever i visit India.

I am glad to see the responses, and am sure that there are more to come. I decided to create a tracker of people who have posted their dates here or confirmed that they are waiting for the audit response.
