SO WHAT IS THE BLOODY PROBLEM??? Wait your turn patiently like everyone else, or upgrade your skills and education to apply for EB2 jobs. Stop bitchin' and moanin' and trying to find shortcuts in life. There are none.

I have resisted to respond to any of your posts till now.
Please note that GC is only one of the life's important things. There are several important things in life that one has to pass till death.
We are suffering like this for our past sins. Few of EB3's might be INS officers in their past life who did not treat immigrants well and suffering now. But past few years have cleansed our sins due to the sufferings we are under going due to GC.
On the other side, you are enjoying our sufferings. You have been hurting every one here including EB2, EB3 or any one that see your post.
Many dictators have thought there is no one to oppose them and God gave them punishment. I am sure 90% of EB3's here will have good life.
And take my words: You will suffer every day from now on. Either you stop enjoying other's sufferrings or count your sins. God will have enough punishment for you.

dont expect any replies...nobody is going to pick up your call...even if u get someone, they wont be able to provide with any useful information...the emails/fax will be unanswered...and the voice mail box will be full...only option is to look upwards to the sky and pray for ur passport...i got my passport after 7 weeks.

At least EB3 I should get its share of Visas, which is not happening. A lot of the visas are being wasted or spilled over to other categories.
Actually, this is really insane logic. If there is any spill over from EB1, it should go to most affected categories like EB3I. But its going to EB2. This is a BS.
At least the following should happen:
1. EB3I should get its share of allocated visas every month / year.
2. Spillover should happen to EB3I (as a most trafficked category)
3. Consider the EB2 porting while setting cut off dates.

DOL filed my application for perm.work permit on March 2006. /so my Pd march 2006/ They approved this application.Then ,we sent the i-140 application form to USCIS.They sent it back,because the DOL made an error concering my salary.The DOL corrected this error and approved once again in October 2006. Now my i-140 is approved,USCIS transfered my case to NVC and to my atthorney in which the priority date is October 2006.Now I waiting for CP .What can I do in this situation? Thanks for Your respondings.

People are loosing hope on CIR. For time being Pl. keep CIR aside. It is election year. we are not priority for congress in this election year. Why do not we ask for filing I485 even VISAs are not availble. If we get ability to file I485 tens of thousands of people will get relief.

I am in new job and mid of negotiating with blood sucker desi employer not to revoke i140. I can not attend the advocacy days.
Anyway like Eb3retro I also lost my interest so changed job. Profile don't meet much with what written in i140, so who cares if GC rejected I will be heading to India.

EB3I dates never really crossed 2001 after the JUL 07 drama which screwed all EB3 in my opinion.
1) USCIS never looked at those cases which got ported out. So if they try to process cases in 2002 they might end up finding lesser cases needing approval than they actually counted, could be bcoz of porting or people who gave up and left the country. USCIS is auto porting the date if you have old labor and i140, I know few friends who got GC like that.
2) At this pace EB2 will be current by mid next year, once it is processing time for 485 is at least 4 months which will fall into 2012, so the same huge number of spill will come to EB3 ROW. If the spill over is too much USCIS may consider spilling it to worst retrogressed countries.
-ve aspect: If USCIS starts doing quarterly spill over this may not happen. So as per my logic USCIS will start doing quarterly spill soon.
3) The as&***s who decided to change the spill to vertical might get bitten by a mad donkey or a dog and might change it back to the old model. I don't see any &&)) why all the spill has to go vertically from 2007, bcoz we irritated USICS or DOS by kissing their weak spots.
4) As per my Karma or belief model whatever IV does, hurts EB3 more. I don't think any admin fix will fix the vertical spill or recapture.
Good luck EB3 i guys and try to keep ur frustration levels to LOW.

And no one with sane mind is going to file EB3, we'll only see EB2 in most cases. Also everyone whoz waiting to file 485 now have got enough US experience to be eligible for EB2. I doubt, even with spillover, if EB2-I will become current even by 2014.
EB2 are more skilled by definition than EB3, and hence the priority for EB2. When we all applied under EB3 (or erred by attorneys), we knowingly filed under EB3. Simple.
Solution: 1) Wait 2) Port over to EB2 if possible 3) Just don't care, live your life in peace.

He meant that 140k Visa numbers allocated each year, out of which less number Visas are actually processed by CIS, all the unused visa numbers in the past which might be more than 300k should be used now to reduce the backlog.

CIS did not issue all those 140K visas for past sevaral years despite of the fact that there were more than 140K applications pending with them during all those years. Those visa numbers were lost and the applications accumulated over the period of time due to inefficient USCIS process.
This is what ombudsman said about this issue and I quote
"For example, when employment-based visas are not used during the year they are authorized, they are lost and are not available for future use without special legislation. In FY 06, over 10,000 employment-based visas were lost, even though USCIS had an estimated 100,000 to 150,000 pending applications for employment-based green cards.36 Based on USCIS use of visa numbers as of May 2007, at present consumption rates approximately 40,000 visas will be lost in FY 07 without a dramatic increase in USCIS requests of visa numbers.37 As illustrated below, since 1994 there have been over 218,000 un-recaptured employment-based visas lost due to underutilization of the employment-based visas. " end quote.

Guys, A friend of mine said he called the Office of Menendez but they did not quite understand which amendment he was actually referring to, I asked him to repeat exactly what he said, then I understood, many of us pronounce Murray as Mu-Ray when it is actually supposed to be pronounced Ma-ri. For those of us, who have green cards, we would also like to participate, if we can add an action item to improve citizenship rules. Most of us have waited 10 yrs for green card, and waiting another 5 yrs on top of it is too much.

that ride was just hilarious...for the record it was vijay who told me "i don't know how i got here...i can't remember", he had lefts and rights nicely mixed up! pratik was in the same car and told me later that vijay did not believe that machine could beat him so he constantly challenged the directions :D
as for sumita (samay)...besides working very hard...she provided great entertainment...don't know what we would have done without her. i'm going to remember her waiving her car keys at me and asking me to drive and then even before the car moved...she announed "not so fast" , took you and me a moment to realize she was saying it to vijay on the phone not to poor me who had not yet moved!!!!! i will also not forget her walking upto the registration desk on rally day and someone said good morning...sending sumita into a real tizzy as her morning "had begun at 5 am" which is absolutely true...since she had one of aman's lost bags and was given no choice but to drive to VA to return it...
yeah and that "tom-tom"...wish she would learn to program it :D
(ok now we are guaranteed to get a response! if not let's make a lawyer joke!)
Okay for the record from my side (Vijay's side of the story). The GPS girl had a sweet voice and she wouldn't talk to me unless I made a wrong turn. Finally I loved listening to her "Recalculating" and I could go on, until Puneet and Sumita interrupted. :p I was in fact contemplating on giving flowers to the GPS girl if not for logiclife's sweet reminder that only he had the rights to be "flowery" :D
May be that is the reason he did not accept flowers from needhelp! Well the bottom line counts, we all had food after long drive on a supposedly short route.
On a side note, someone told me D.C is was very nice to see at night, so was trying my level best to make Pratik, Jay and Vandana enjoyed sight seeing enroute to the restaurant!:)

First of let me tell you life is not fair. All BEC people everyone in this forum empathizes with you esp me since my husband is also a victm, even if they say u should have filed in PERM. I know for a lot of folks this was not a choice for you to make sometimes it is the company, lawyer, ur job situation that is the determining factor. So, please hang in there and contribute without bad mouthing IV. Maybe some of you should become a part of the core and fight for ur rights. The reason I say life is not fair bc people like my husband and I we are not in IT or work for IT consulting companies yet this whole backlog is created bc of that particular industry and abuses to the H1B system and we still suffer. Also, what happens when u work for huge companies that usually don't hire h1b but once they made the step they don't want to loose you since you are an investment for them and hence the wait 5 years to file ur GC. Again life is not fair when the business needs you to move to a different position, or downsizes and you have to start from scratch all over again. Both my husband and I are here for 10 years and are on our 8th year of H1 and this is the first time for me to file 485 with 2006 PD and his labor still has to be filed yet again in Perm. My point life is not fair but you cannot blame others. Very few people are lucky and get GC in a year or year half. If you look most people had some struggle some worse than others. Just be grateful that someone is ready to atleast listen to you and help you fight this long battle.

You can move but are you changing employment? If yes, AC21 kicks in only after 180 days after filing 485, assuming 140 is approved.
2. We do have a PO address is Texas now and have an apartment in CA for next 5 months.
Do you recommend to use the Texas PO Box address instead of California Apartment address for USCIS I-485 application such that we can avoid the Change of Address with USCIS later?

From what I understand, a conference committee is generally only formed once major difference have been ironed out in the back rooms. In fact the conference committee will only be formed to make the process formal. Again Senate majority leader Bill Frist had talked about the formation of the committee immediately after they came back from recess. That time is far gone. Given this situation it seems that there are some very serious differences that have cropped up. Taking the risk of sounding pessimistic it appears that momentum gained by all the headlines seems to be losing steam and the issue seems to be slowly disappearing from national attention. This can have both a positive and negative impact. The positive impact is that legislators will find it easy to do their work. The negative impact is that legislators will maintain status quo as that is what they like doing. For those opposed to the bill it is better that CIR bill is not taken up now as it still serves their purpose. For us it is always better that something happens to the CIR bill.

i met a guy like this last weekend. came to US 2/3 yrs back. has masters in India and has 5 yrs total experience. not doing any research. He is actually a contractor at a client. the employer, applied his GC under EB1. he got GC under 1yr. I was amazed.
he says, his employer applied for few of his other colleagues too, but rejected. most amazingly, for one of his boss (1 or 2 levels above him) also they applied under EB1 but his app was rejected. unbelievable stuff. i guess the EB1 verification is random.
EB1 spillover may never come for some time in the future. The Indian IT companies are applying under EB1 for their PMs and Senior PMs (req: BS in any discipline + 6-7 yrs exp), labeling them as multi-national executives. They are also making the employee pay for the 140 and 485 so that the financial impact is reduced a lot by a potential rejection of the 140.
This is as much BS as labor sub. I think everybody here knows how tough it is to get EB1 classification for researchers. But what scrutiny is there for these "multi-national executives" ? All they have to do is spend some time in India or any other country as a PM or SPM, come to the US on H1B and promptly apply under EB1. :mad:
