EB3 ROW PD is back to 2002, as mentioned in this thread, however this case (like my own) highlights that you don't have to have PD current at time of GC approval. What makes this extra surprising is that this is a JULY filer (I was June).
It goes to show that Name Check can happen speedily (and refer to other postings for recent updates on this front)

I couldn't confirm it but from what I understand, the dual intent will no longer be valid on H1 ie A H1-B holder cannot have an immigrant intent. Does that mean, they cannot file for a GC, while on H1? Also, as consulting would be severely restricted, how many of the H1s will be able to find Full-Time Jobs?
As we read more into the Bill, the 'hidden' intent is becoming clear..

They have not taken dual intent off H1b visas. Our major killer is however the restrictions imposed for extension beyond 6 years. We need the employer's recomendation + >365 days pending 140. I dont know whether one of these would suffice or whether both would be needed??? Otherwise it looks not VERY bad, but bad.

GC is for better working conditions while being here in US. If US says that you can not work here anymore, then clearly , only option is to go back to your home country.Lot of people want GC so that they have freedom of changing jobs,starting their own business,spouse work etc. Desire to serve home country or not has nothing to do with it.

E-filed AP & EAD renewal for me and my wife at TSC on Jul 07th.
Got soft LUD on Jul 16th for both applications right after sending supporting documents.
Got EAD renewal approval on Jul 29th for both of us.
Still waiting AP renewal approval for both us after almost 100 days pending.
Have to attend an important business conference in Argentina on Oct 22, paid for registration fees, flights, hotel, etc. almost Usd 10,000.00 in costs and USCIS National Customer Service tells me this week I have to wait another 65 days !!!!! They said TSC is processing AP applications of May 23rd!!!!! Can you believe that? Had to call again and another representative opened a SR last week. No actions from USCIS so far. Went to an Infopass appointment this week and got same reply "you have to wait your case is still under review and within processing times". Sent a complaint and support documents to USCIS Ombudsman yesterday. Let's see but at this point I don't know what else to do. This is ridiculous, having almost to beg USCIS to do their job right, when you paid high for it and they simply ignore you. As usual treating you as another number in the files. Simply very disrespectful!

If you really look at who is paying less and misusing the H1-B and L1 to manipulate the job market, its the big offshore companies who bring the less experienced folks from India/China and other asian countries into US. These biggies pay way too less (52 to 57K) to these folks than what the conultants who work for local consulting companies make.
They apply for 1000's of H1B's and L1's showing the positions in US but 60% of the folks works back in their offshore centers in China or India with H1B/L1 stamped on their passport. Question is, if they applied for H1B / L1 based on an existing position in US and gets approved, why is that folks are still working in India or China center? Doesn't that mean they faked the position?
When we consolidated the vendors and excluded all the local consulting companies to include only two of the big offshore companies, we have seen their consultants brought onsite leaving them after few months at our group to join local consulting companies for better pay.

Few days ago, the IV team was looking for genuine people who got their I-485 denied because of AC21 issues. You should try to contact them. They will be able to help you out.
Also try to write to Ombudsman of the wrongful denial. This is all if indeed your AOS was denied because of I-140 revocation and pending AOS after 180 days.
Can I ask you something? Is your case a labor substitution ? If it is,I know that if the company tries subsitute a labor for a person whose moved using AC21 for another person that is not allowed.

i've had an NRE account and the only way to put money is in $. you can then withdraw the money in $ or Rs, but i haven't heard of being able to fund it with Rs to start with.
i believe that students can also bring a much bigger chunk nowadays, maybe try that track.
also, if the $100K can be brought to the US each yr, why can't parents send it here as a gift, what is the deal with 30%, does someone know?
