I will try to explain the process it takes to get qualified for EB1C.
You will need to be outside USA for an year working as an Executive or manager. Come back to USA in that role. So the appropriate visa will be L1A. Most Indian companies require atleast 5-6 years of experience before they look at your resume for a manager. Most of the managers now a days get fired if their targets are not met in couple of quarters. So staying in that position for couple of years it self is a big deal. Now they need to prove the candiate valid for L1A position. Face a visa interview and come here and start working. Even if the same company is sponsering the L1A. Compaines usually wait for an year or two before they file I140. This application wll rot in CIS queue for long enough before they get a decision and GC.
This is the actual process.. If some company works in an apartment in India with one man show and tries to get an L1A, I am not sure if they will get through and get a VISA??? It is quite common that we have more EB1Cs becos, the number of Desi companies have grown. So if you think you are experienced and want to give a shot, try it. These kind of complaints in a longer run will bite us by delaying the applications and building backlogs..

1. Begin by contacting the office of the Inspector General of the Department of Labor. That office is supposed to ferret out mismanagement and misconduct within the agency. With cases pending as long as they have been pending, something is clearly wrong.
2. If you get no response from the IG's office, next prepare a formal letter to the Secretary of Labor, asking for assistance.
3. If that doesn't work (though it should), next contact the chairs of the House and Senate immigration sub-committees and file formal complaints, requesting their help. If you include a large number of victims, this should impress them enough to contact the agency to find out what's going on and get it resolved.
And also Ron Gotcher ready to help us.
So please guys post your inputs and what can be done futher. Its a collective effort and have to help outselves. Here is the action plan.
1. Rather than every one sending separate letter, let us send only one letter and every one signed that.
2. Let us create one yahoo group, send all your infomation, Name and adress.
3. Draft a letter to OIG, attach all our information.

I have booked my tickets. I will fly in to DC by Saturday noon and fly out Monday evening. I got greened last year and I owe a lot to team IV and its members. I used to be very active on IV and always a good friend to Pappu, Aman, Jay and all other IV members.
I have done lawmaker meetings twice in the past and would like to share my experiences with you all and also help with talking points etc... based on experience.
I appeal all IV members to take advocacy seriously. Changes come only through persistent efforts and thats exactly what IV is doing. Most IV core team members already have green cards or are citizens and they don't need to do all this, but they are doing it because they believe that persistent, sincere, honest efforts would definitely reap benefits.
Please contact your friends, relatives and co workers. Conduct local meetings, explain to them about IV and what it is doing. As IV members are well informed and understand the situation - especially EB3 folks, ignoring such events and not doing anything active is not an option.
Why is the advocacy day so important? This is politics 101. One can be a great doctor, great engineer, great scientist and anything, but at the end of the day, we need to understand the dynamics of things and how things happens and do things accordingly. We are all great achievers primarily - we went to good schools, worked hard, got good jobs, able to migrate to the US and have excellent leadership qualities, we have good friends, nice families, great kids and cannot complain about life in general. But getting delayed on GC is very frustrating and if we do not understand what this is all about and what it takes to find a solution, then we are just missing that essential thing in life which is "what we would need to do to change things that helps us all". Reducing GC backlog and streamlining process is a win win situation to all and such message needs to be conveyed in an appropriate way. It is our issue and we need to take it up and not expect things will fall in place automatically.
These days I see so many campaigns on facebook, twitter, etc... and the world is not like before. Public voice and opinions are being taken very seriously and if we do not live up to the times, then we basically lose big time.
Do we want to lose it? I am sure we want to win.
Can we all unite and help ourselves? I am sure we will.
Can we all come forward? I am sure we will.
Folks - we are all creative in different ways. Lets do what we can to further our cause. I wish a lot of people change their minds after reading my message.
I will keep posting inspiring messages when I get a chance.

I have not been FPed recently. All 3 of us (me, my wife and daughter) were FPed in 2007. Then we filed for renewal in 2008 and got the EAD with no FP.
I was told by an InfoPass officer that FP are valid for 15 months..and after 15 months if PD is not current - they electronically re-validate the FPs.
Then I had called USCIS cust serv and they told me if my PD did not become current by May '10.. I should get FP notice..since it will be 30 months (15 + 15 months) since my last FP appt.
Anyone has info about my Que no. 2 ??

I would like Representative "Representative Name" to co sponsor bills HR 5882 and HR 5921, sponsored by Zoe Lofgren. Both of these bills have wide bipartisan support in the house and will help reduce the back logs associated with USCIS. These bills are a great first step towards immigration reform.
DO NOT GET INTO THE LEGAL/ILLEGAL DISCUSSION WITH STAFF MEMBERS
Only if the staff member bring up the issue of CIR, in that case say that -
In the past we have been supporting Comprehensive approach and still continue to support comprehensive approach and we look for our our main issues to be addressed whenever comprehensive bill is passed. However, this is is just an interim fix to begin or start the immigration reform process.

This is a wonderful idea. Having waited for 10 years for green card, if one has to wait for 5 more years for naturalization (that allows one to vote in the elections), then it is indeed an utter discomfort. We need something like IV but with a different name: NaturalizationVoice (it would be envy -NV- of all in IV ;-)) to campaign for immediate ready-to-serve naturalization of highly skilled (like Saralayar, of course) permanent residents.. NV should also campaign for an amendment that would allow highly skilled immigrant turned naturalized citizens (eg. Saralayar) to contest as presidential candidates. If any such person wins, he or she could either ban immigration (at least for other high skilled people) or abolish waiting period for greencard.
Makes sense, like the idea of abolishing the waiting period for GC.... but with all due respect i belive that will never happen esp in a post 911 era where there is a lot of checks. I belive if they put the name check process in a fast track it would be benificial. Suks that we have to wait another 5 years after getting GC to get Citizenship, if anything i would think counting 5 years after 485 is logical.

If the petition is filed as a COS H1, then USCIS should approve it with an attached I-94 unless there are any doubts in which case, it still approves it but without an I-94 and sends a cable to your home country visa consulate where you would have to go and get the visa stamped before Oct 1st and come back to start working...

I have a question as follows. I was with an old company and transferred the H1 in the 9th year to the new company. I already had my Labor and I-140 approved with the old company (EB3-I Category).
After switching to this new company I had to start my PERM all over again as I missed the July 2007 boat and could not file for I-485. My new company is based in L.A.-California. I am already drawing my salary from new company. They only have office in L.A. I work for them from my home office in NJ. Today the company's attorney called & asked me that I needed to have L.A. residential address as it is required to be stated on the application. I have no intentions to move to L.A. in near future. I am in a fix now as to how to go about this. I will appreciate all you gurus and experts advice and also please advise me repercussions if any.

My employer says that he has lodged my PERM in July 2008. As yet there is no news and neither does he provide any information regarding the status. Is there anything I can do to find out whether the PERM has been lodged at all? What are my options?
Try contacting the attorney who filed for perm (if attorney was used), don't mention that employer is not providing you any information. You don't have much options as you will need your employer's or attorney's login details for DOL website to check status.

The reporter doesn't know what he/she is talking about. I have seen a lot of inaccurate information coming from Indian media about visa increases but this has to be the worst one. It not only claims that the visa increase amendment has passed in the Senate but also that minimum wage bill is yet to be considered by the house. This bill was passed by the house in the first 100 hour marathon.
I don't know from where this reporter gets his information from .. may be from immigration-law.com. :)

I sent my passport for renewal during first week of Oct 07 and still have no clue about the status of my passport. I am at their mercy now, hoping & praying that I will get a new passport soon. No one gives any updates. I just cannot seem to get hold of anyone at this consulate when I call during 2.00pm -4.00pm to check on the status of my application. If by mistake anyone picks up the phone, she does not have any status update and asks us to call after few weeks again.
I sent email & fax to see if I can find out anything about my passport, but no one cares to answer. Their customer service is pathetic to say the least. If only I can find the email address of Vice Consul or that of Indian ambassador in Washington DC, I would like to send a detailed email about the kind of service I received....knowing very well that it will not serve any purpose to anyone. Thats the way those idiots work, and no one can do anything about it.
You are absolutely right. The Indian embassy and consulates are the worst places to deal with. I have had several experiances at different locations, they proved to be equally pathetic. Thay don't pick up the phones at all. They all have the same attitude of our govt offices in India "What will I get, otherwise we don't care".
You can e-mail them or fax them or call them. Your call will never be returned. I needed a document to start my residency in 2004, I tried all possible ways, nothing worked. Finally I found Ambassador's e-mail from one of my family friends, who is a senior IAS officer in Rajasthan and e-mailed the ambassador explaing my situation and mentioned that atleast I deserve a phone call from the Consulate for being a citizen of India. Later my work was done in a matter of hours. But I cann't e-mail Ambassador for everything.......
The best things one can do are
1. Try to go in person and get your work done ASAP.
2. Get all possible documents like OCI, PIO cards, visa etc, for you children even they are not needed.
2. Don't lose your passport at any circumstance. (you may even forget your life saving medicine, rest assured, you can get them in an hour)
3. Avoid embassy or consulate at all. Don't even take that road.
4. Encourage all your enemies to get some thing done from Indian consulates,. Trust me, they will never find time or energy to bother you.
I guess we all need to raise our voice and let the ambassador know that they have a clear timelines for all citizens at least in America (Forget about in India)

Guys, My personal opinion. Pls do not fall for these risky trading tactics. I'm in no way against trading, but cautioning you whole heartedly..............................

I have repeated that in almost all my posts earlier in this thread to not think of this as a "GET RICH QUICK"scheme ........

Let me go back to the start
I recommend this style of trading for entrepreneurial kinds only who have the fire and will to learn .
Its risky but it is fulfilling when done in the right way.
It is easy to loose your shirt if you are not disciplined and stick by the rules (More on how to build your rules later)
GREED is the one number one enemy of PDTs.
Overcome greed and you will love to trade....you will love to convert your loosing trades into winners.
I welcome comments from traditional traders as they serve as a filter as well.
To say the least ...my dad who has been an active investor for years is still against DT or short term trading since he is a traditional investor.
No doubt you will make money there too but its like planting a seed and watching it grow every minute .(In a good , long and boring way I think)

They retracted number of times in the past.
Good intentions, but have to re-check what they post before posting.
Cannot believe a Law firm would do such mistakes....but it's a fact.
But I really pray, they are right this time (Though our in-depth analysis says otherwise)
