I am in EB3 and PD is nov 2003. I am eligible for EB2 and I am feeling sick of EB3 and would like to port to EB2. Is it good idea or not?????

My Co worker a Canadian citizen was applying for GC under EB2.
Our company's lawyer screwed up and applied his labor under EB4.
This is big big big problem as his TN visa from canada cannot be renewed as its given on a non-immigration intent and he cannot apply for green card this next month as he has to restart the whole process(labor) again.
Can he apply for PERM using the old advertisement?
What are his options?
Any help would be much appreciated.

This warning was issued in the March 2000 VB:
VISA AVAILABILITY FOR APRIL(2000)
�Demand for immigrant visa numbers by INS for AOS cases in all categories, continues to be steady but has not reached the level requiring action at this time. It is anticipated that INS demand for numbers will require the establishment of visa cut-off dates for April in some or all of the CHINA-mainland born and INDIA Employment categories�.
In May 2000. EB2 was retrogressed to 01JUL97 for China and 01APR99 for India
In December 2000 VB the big announcement came:
Greater availability of EB immigrant visas: On October 17th, the President signed P.L. 106-313. Title I of this law is known as the "American Competitiveness in the Twenty-first Century Act of 2000" and contains amendments to the INA regarding EB immigrant visas.
In fiscal years 1999 and 2000, due in part to the per-country limits, the annual limit for EB immigrant visas was not reached. P.L. 106-313 makes the following changes in an attempt to rectify the situation with regard to per-country limits:
Section 106 recaptures those EB visa numbers that were available but not used in fiscal years 1999 and 2000, creating a "pool" of approximately 130,000 numbers. These numbers could be made available to applicants in the EB1, EB2 and EB3 preference categories beginning in fiscal year 2001.

Some members here also mentioned before, you can submit the translation by yourself incase if they don't have Kannada language translation available. I am not so sure about this though.

Why do I get a feeling you are incapable of digesting the concept of "Law of the land". There are certain rules that govern PR & Citizenship statuses ( of all countries)and only land mark & ground breaking edicts can alter such law�s , and that too very slightly. How can we confirm the spillover interpretation. I am not familiar with the spillover rules but my understanding was that only if there in an excess in EB2 then the spillover gets down to EB3. Am I wrong or as per rules should spillover be distribued equally? If it has to be distributed equally then we need to do a mass mail or something and ask USCIS to explain. Even if 50 of us send letters to USCIS ther mihgt be some action.

I assume you all checked ur GC wait time - which probably gave u like 10yrs or 18 years from today. Are you expecting vertical spillover to put you on fast track lane?? say getting a GC in 2010? 2011?? 2012???
vertical spillover will only help EB3's that are very close to Visa Bulletin dates.
There are app 200k people waiting, changing how they allocate leftovers is not going to help 200k hungry people. What we need is more food (more Visa's).
I am awe'd by the shortsightedness of the solution being discussed in this thread. Do you really think vertical spillover is going to help an EB3 > jan 2006???
when we are ready to spend "X" $ on getting a law change for "vertical" spillover, why not spend "x+y" $ and put same effort and get a permanent solution - "Visa recapture" ???
Moreover the latter is certainly going to get you a bigger participation from EB community. Visa recapture will benefit the entire EB group and future applicants too.
I strongly urge you folks to think about these.

It is simple human behaviour - we are all here to safeguard our own interests. Not still sure if the forum is going to side with EB3 or remain neutral. Surely they can support EB3 - they have the liberty to do so and it is perfectly right. In that case, EB2 should create their own platform to defend their interests... May be EB2 guys should think about it...In my opinion, everyone has the right in a democracy to work legally towards their goal / ambition . This is absolutely jutsified. It is not a sin. All that I am trying to say is that EB2 folks should be proactive and act before it is too late.
If EB3 were to race ahead of EB2 tomorrow, will they support EB2 or work for equitable distribution? How many amongst EB3 have used the Labor substitution to their advantage? Will they back out now? Let them touch their heart and answer this, instead of giving red dots :)

2. USCIS is not asking to prove relationship with your great grandparents every time you go for H1B extension
3. You don�t need to worry about the VO at POE or consulate and not postponing your India trip for 3-4 years now.
4. Even though you are on project and pay roll is running, paying the tax...don�t lose your sleep over what memo comes next before the next H1B extension.

As I already clarified, I had stopped worrying about GC, long time ago, not after getting EAD.
I bought a house when I didn't even start my current GC process.
I went to India (Chennai) in my 7th year for H1 extension stamping (after completing 6 yrs of H1 and before I even filed 485). I didn't postpone it till I got EAD.
I left my employer who had filed for my labor in 2004 because he started acting up at the end of my project and started GC process with new employer well into my 6th year.
I do understand some people run to IV only in time of need. But all I am saying is not to paint everyone with same brush. Even if you think about people who want anything to do with IV only when there is need, lets try winning them over rather than stating the obvious and ridiculing them.

Exact same dates and similar machine readable card for my spouse :). Original card was valid till 7/30/2010 - new card valid from 5/14/2010 - 5/13/2012. So she lost about 2 1/2 months.

Just cooking up stuff classifies as a multi national.I know a guy who is a business analyst on L1 visa got his GC in 6 months time in EB1 category by a well know consulting company stating him as a Manager..The guy was bragging and showing off his white card ,and telling how he got his GC in 6 months
