Now this is what is going to happen.
Because DOS and USCIS screwed up big time playing loosely with laws and expecting no reprisals for their actions, they will now beg/borrow for the lost visa numbers and make them available for July filers.
I see no escape route for the mess up. Rice, who did not pay any attention to this fisco gave her on the lip casual response to MSNBC reporter.
It looks like this issue is bigger than Iraq from security stand point of view and also with latest information of Al-Qaeda making statements to get into US for attacks.

Mr East India is so EB2 intelligent that he does not hesitate to give a lecture to the dull EB3 guys. Here is a lecture to you from a lowly EB3 worker. He pompously states that it is the job requirements that classifies the job as EB2. But completely glosses over the facts that most of EB2 job certified as such, really do not require a mandatory Masters degree. This is where the slick lawyers come into play by tailoring the job as EB2. Most of the American colleagues of the so called EB2 advanced skill "inventor" do not have a Masters degree doing the same job. Also, most of the Masters required job ads are found especially in our nurturer of highly skilled programming "job shops".

I have never run before............not even a mile. I still cannot and have just started training for the DC 10 miler. So please do not feel shy about running even if this is your first time. We are willing to answer any questions that you might have...........but please signup; set a target and start ASAP. Worst case you will end up walking instead of running.

I am in EB3 and PD is nov 2003. I am eligible for EB2 and I am feeling sick of EB3 and would like to port to EB2. Is it good idea or not?????
Great Idea.. there is nothing to loose, if your employer is sponsoring for porting. If all stars in favor of you will be greened in another 1- 11/2 years Max with EB2 porting

This is depressing at best but lets take what lifes throws at us(in this case USCIS) and turn into positive.
We should have some action items and follow through. Below I have comeup with some as starting point..
1. Prepare campaign materials, message (short and long), stories etc regarding this backlog.
2. Pass it along to media. Schedule meetings with Senators, congressmen through state chapters and educate them.
3. Volunteer in our communites as groups and spread the message and hopefully get some media attention.
4. Contribute to IV for lobbying.
5. Stay positive and don't stress too much regarding the GC.
Ideas don't cost us much but what we need now is actions.

I have received approval on April 04 and today I have received GCs for all my family but not for one of my daughters. I checked USCIS and I just realized her application is still pending. She just turned 14 on March and she only did FP 2. Do you think she has to do again FP or they just left her behind......
Same story here. They will send RFE for biometrics for her. Expect it within a month, if you do not get it in a month, take Infopass/call and ask for biometrics appointment. My daughter's I-485 was approved next day after FP.

I'm telling you, most likely even if it retrogresses. PD will go back uptil 2004-2005. Most cases are filed after 2005 March.

Is it ok to send faxes? and is there a format that lot of people are using or its personal story for every one?

I talked to a staff member at senator Barbara's office, and the staff member said, Faxes and emails are responded and replied by staff reps. Only written (typed) letters go to Senator's attention. She also advised me that if this is something you need the senators attention on, do not send fax or email, send a letter with postage paid.
I explained to her the visa -flip flop, and she said most likely the senator will read and send an inquiry, The senator is very good at responding to letters from constituents.
That is exactly why we need to send them letters, please look at the format and add some personal details, gives it a little personal touch.

Out of 800,000 visa pending is it reasonable to say that a majority of the cases (maybe 400,000?) are cases with PD >=2005?? If so the number of pending cases with earlier PD dates (2001 to 2005) will be less. If you break this down by year, the number of pending cases by year does not seem much.. If they process by PD they should clear older cases like 2001 -2003 or even 2004 by end of 2008??

Your logic is not right. They are still American companies as they are based and incorporated in the US. Number of employees in India does not matter. It would be different if they had a majority of Indian employees in the US...

Thank you everyone who participated in the campaign!
Three important next steps:
1. Let us all (every member), start and continue working on the IV action items such as "Meet your Lawmakers", "Call Lawmakers", etc. If we can do these now, we will definitely be able to influence the upcoming votes in the House and Senate on the immigration bills. And these bills are coming pretty soon (in a matter of weeks). So now is the time to act!
2. Let us all contribute as much as possible now. OUr donations will help IV in its lobbying effort. The more financially strong IV is, the better it can work support on the hill.
3. Last but not the least, we cannot stop at 10000. The stronger our numbers are, the more effective we can be (both in campaigns, as well as financially). So I am upping the target here. Please help introduce ONE member to IV by the end of April. If everyone of us added just ONE member by end of April 2007, we would be a 20000 member strong team.
20000 might look daunting, but's it's really not every individual just took care of his one member.
ADD ONE MEMBER BY APRIL 30, 2007!

I like pursuing option 3 and 2 at the same time. We don't know if option 3 requires a law change so need to clairfy that. While we prepare the slides/etc I think we should contact USCIS first and while working with them educate the law makers on EB3 category based on the points similar to below.
The fact that EB3 category requires less experience than EB2 shouldn't be looked at as EB3 applicant is less skilled. Infact I have applied EB2 twice and now in EB3 and I do have US masters and 10 + years US experience. It all depends on company's attorneys comfort level.
It shouldn't be viewed as we are taking visas away from EB2. Infact we are requesting realisitic approach to the skill sets. Instead of EB2 Current and EB3 at 2001, EB2 can be couple of years ahead of EB3.
We can come up with many ways to explain the injustice but it is time we ACT. I am with you on this.
Lets not get sidetracked by Mr Skillz with a Z.

Option 1: CIR - This is not in the picture right now. Nobody knows when this is going to happen and I think we should not even bother to look upon this as a short term measure.
Option 2:Recapture of visas - Again this has to go through the legislative process. With the current political climate, it is going to take a tough task to get this one in as well.
Option 3:Re-intepreting and changing the spill over rule: This can be done without any legislative changes and USCIS can be asked to look on this if we can really force them to.
Steps to execute Option 3:
* Collect and consolidate all the data in a spreadsheet from the latest 485 inventory to the yearly reports of adjudicated cases
* Create a what if analysis for the next 3-5 years for EB2 I and EB3 I
* Create analysis to show what will happen with the old rule and changed interpretation of spill over
* Create a nice presentation
* Contact Senators, congressmen, USCIS and walk them through our presentation
Hopefully that can change their mind or atleast we gave our best shot.
