Democratic victory may pave the way for Bush's immigration plan

WASHINGTON - If President Bush can find a silver lining in the Democratic takeover in Congress, it could be this: The outlook for enacting his sweeping immigration plan, which House Republicans blocked for two years, suddenly looks brighter.
A 700-mile border fence pushed through the Republican Congress also could come under renewed scrutiny. Although Bush signed the fence legislation into law, Democratic leaders opposed the measure and may hold up funds for the project, which is expected to cost at least $2.2 billion.
"I can't think of another issue that could bring together the Democratic Congress and the president like immigration," said Frank Sharry, executive director of the National Immigration Forum, which supports the president's initiatives. "This election has really changed the immigration debate forever."
Pro-immigration groups such as Sharry's predict that the next session of Congress will be far more receptive to the most volatile elements of Bush's immigration plan: a temporary guest-worker program and conditional legalization for millions of undocumented immigrants now in the country.
Since Bush first unveiled his intentions in 2004, those proposals consistently have collided with resistance in the GOP-led House of Representatives, which refused to consider a Senate-passed bill that largely embraced Bush's initiatives.
Now Democrats will take over the House and Senate in early January under leaders who've expressed support for a comprehensive immigration overhaul.
Presumptive House Speaker Nancy Pelosi, D-Calif., has called for legislation offering illegal immigrants a "pathway to earned legalization and citizenship" if they fulfill "tough requirements," such as paying fines and back taxes, staying employed and learning English.
In a post-election press conference on Wednesday, Bush again listed immigration as a top priority, describing it as "an issue where I believe we can find some common ground with the Democrats."
"I do think we have a good chance," Bush said.

You are right. Things aren't moving fast enough because there is a general lack of participation from the otherwise intelligent EB immigrant community.
Even if 20%-30% were really proactive in supporting IV, things would have moved much faster.
We need to develop really intelligent strategies considering all the factors. Just throwing out ideas and organizing rallys may not be enough (although needed).
There are a lot of intelligent people on this forum. I think we need to work on our unity, commitment and implementing of strategies.
IV is already doing lot of these but does not seem to be working fast and effective enough.

I'm went to the infopass website to make an appointment for interim EAD; I chose the "Washington Field Office" since I live in the DC Metro area. There are no appointments available in Aug and Sep!

I went through the Federal Firearm Law and here is what I found:
(d) It shall be unlawful for any person to sell or otherwise dispose of any firearm or ammunition to any person knowing or having reasonable cause to believe that such person�

As per my understanding, if you are legally in the US, you can own a small firearm...walk into a store and tell them u need a gun and they will tell u what paper work you need or go to your local police station and ask the requirements. The following are various ways to express some one�s dissatisfaction/agony and draw some one else (Government/Media/Public) attention.
1. Daily Fasting : One or more people would sit for fasting from 6 AM to 6 PM. One group would pass on the fire to next group.
2. Continuous Fasting : One or more people would sit for fasting 24 hours a day. Such people should not have health issues like Blood Pressure, Gastric Trouble, Sugar, insulin deficiency, Heart relates issues. This may cuase arrest.
3. Protesting : Conduct a rally with group/mass of people with immigration ply cards and banners.
4. Wearing Black Ribbons : People would wear/put a small black ribbon on their shirt pockets (Upper left side of the chest) and attend duties. We can draw people attentions. Such ribbon should have white color immigration slogan printed on it.
5. Distributing Flyers : Distributing Flyers/Handouts to people in respective areas.
6. Banners : Display banner/show outs in the Traffic Island Medians
7. Flower Campaign : Sending Flowers to respective people, also called Gandhi giri.
8. Silent Sitting : Sitting in front of USCIS silently (no talk).
9. Silent sitting in front of Senators house: Group of people should sit (kind of protest) in front of respective state senators. We can draw maximum MEDIA attention.
10. Sweeping Roads : A group of people would sweep roads by wearing immigration slogans jackets.
11. Organize Blood Donate Drives : Interested member would donate blood (We should explain to media, why we are doing so).
12. Rally in All Major Cities : Conduct a rally in all Major cities (where we have at least 100 members) at the same time.

so with respect to EB folks, this provides GC aspirants (with 5 year stay) an immediate relief. The total quota numbers are not modified. Everything stays as is. This appears to be a one time relief to free up the choke in the system (at least for EB).

The text of the current bill states that the applicant needs to apply under this bill's section to adjust status, similar to 245i. Now if this means reapplying under this section, that would mean another flood of applicants. Obviously with such a deluge, you wouldnt need a quota, the CIS system itself will take years to sort out the applicants.

1) AC21 is used for H1B Transfer AND

I agree, FP does not have anything to do with namecheck. I never received my FP for 15 months but inbetween when I took infopass - it was confirmed that my name check was done
I was under the same impression that it was FP that triggered the name check. But this is what the lawyer told them that their names were struck in NC and that is why they never got FP and now that NC is over they received FP notices. The interesting part is that within 3 weeks of FP one person got a notice that his application has been sent to USCISlocal office for further processing which I assume means interview notice in few days.

I would also check if your original GC sponsoring employer (Company A) is not involved in any fraud investigations by USCIS. In which case, USCIS can revoke an approved I-140 without any notice on the basis of fraud, which would automatically lead to your I-485 denial. I-140 online status may or may not change in such cases. Your case being in extended review is raising some flags. Do you know anything about the kind of extended review that was going on. Your lawyer on file, as well as you should get a copy of the notice. Make sure no communication was sent to the lawyer from Company A. Sometimes USCIS does not update the lawyer information even though a new G-28 is submitted. You will have to just wait for the denial notice. Send an email to info at immigrationvoice dot com so IV can get in touch with you to help.
I do not believe original employer was involved in any Fraud but he did have financial trouble ( paying salary after 2 months , check bounce etc - that is the main reason I left) .
That company is MSU software based in Iowa ( just in case if anyone knows about it ) .

Patience does help, and maybe all the good is stored for future.
Most important is how you deal with stress associated with racial slurs, difference in treatment, and all the above issues. This has direct impact on health and many people in these conditions are victims of stress.
The h1b - GC situation is well known to everyone and they know you are indentured, some managers are called problem solvers (they pretend to hear ur voice, help you from their side and get the work done and try to ease pressure off you if they have an option), whereas some managers are called problem creators (they add additional pressure on you and make u miserable so that they get the work done). The reason companies support their American workers who involve in racial slurs is to avoid issues. It is easy to kick you out and blame you rather than catering to ur problem.

Its very hard to do that..speaking of which this anti-indian guy who sits next to me at work was making life horrible for few weeks. Things are sorted out now... I have a great Manager.

Undocumented Immigration can be solved within a week. But no politician or anti-immigrant wants to talk about it.
SIMPLY PUNISH THE EMPLOYERS EMPLOYING UNDOCUMENTED.
Just put some US citizens who hire undocumented in Jail and then nobody will hire undocumented. All undocumented problem will be solved. But nobody wants to enforce laws on US Citizens. But everyone wants to enforce laws on undocumented because they do not see these undocumented as human beings.
Instead of deporting 14 million undocumented, and wasting money on this. Just punish 1 thousand US citizens for employing undocumented. I am sure you will see some hidden anti-immigrants being jailed too. The greedy employers promote undocumented immigration by employing them, exploiting them and paying less salary. Why not punish the employers.
No anti immigration site wants to actively work on this action item. WHY?

I just want to make sure that IV not forgotten People that stuck in PBEC. So far as an active member and an active contributor for IV I have to say that I'm dissapointed as far as the way IV addressed PBEC Issued.
Most of disscussion in IV forum seems like focusing on retrogression issue only.
for people that have their case are among 350000 case pending in PBEC the retrogression has no effect at all unless their case clear out before the retrogression get solved.
There are so many of us had been waiting for their labor get approved.
5, 6, 7 year are a long wait.
I noted that IV do have PBEC mentioned on the web fax, but please make sure that retrogression is not the main goal of IV.

I just want to make sure that IV not forgotten People that stuck in PBEC. So far as an active member and an active contributor for IV I have to say that I'm dissapointed as far as the way IV addressed PBEC Issued.
Most of disscussion in IV forum seems like focusing on retrogression issue only.
for people that have their case are among 350000 case pending in PBEC the retrogression has no effect at all unless their case clear out before the retrogression get solved.
There are so many of us had been waiting for their labor get approved.
5, 6, 7 year are a long wait.
I noted that IV do have PBEC mentioned on the web fax, but please make sure that retrogression is not the main goal of IV.

We have 24H to work hard to create maximum awareness to media. Please don't forget to mansion Mahatma Gandhi's philosophy behind this flower campaign. Let's work hard today and see the impact tomorrow. I wish some news channel cover live delivery of flowers at USCIS HQ.
I am not saying that it is working on the USCIS. We dont know yet coz the flowers start reaching there tommorow. If it is working on USCIS, we would know by the end of the week. Not now.
But it is working on the media.
What I am saying is we are getting a good amount of attention from a lot of newspapers - which is important to create more awareness on the plight of half a million law abiding immigrants and the backlogs they are facing.
