I-140 is approved. I-485 was filed in July 2007. I have an opportunity to move to another company for a similar job profile. But the new company wants me to work as a contractor (hourly) on W2.
Is that a problem when filing AC-21?
Please advise.
You can be paid hourly or weekly or monthly or by weekly, does not matter as long as your job is fulltime and in same or similar occupation. Hourly pay is a more convinient tool for employers to keep you as contigent worker at times it works both ways because you can get paid more if you work more hours (depends on the state I guess).
You may verify the same with lawyers and gurus.

Try to respect people who are trying to 'buy' an MS degree for the purpose of greencard ? Instead of feeling sorry for their situation, you should feel sorry for the legit EB2 applicant who these guys screw up by taking this backdoor approach.

I understand it is a mess and I never suggested it should not be solved. However, I know a lot of my friends in PBEC who will apply PERM (pri dates 2003/04) if the pri dates for India became current.
And I am myself stuck in Dallas BEC which is not even taking a look at State cases. And yes, if EB2 became current, I will file another labor in a jiffy. So, yes, it is a mess there but we got to look for avenues out of it.
I am , in no way, suggesting that we should not support PBEC overhaul if thats what it takes to get labor approved. But right now, Comprehensive Immigration bill is about GC and H1 numbers for us, it will not deal with labor backlog, USCIS backlog etc. So, what do we do now - should we raise an issue that politicians will hear, but not act on, or do we raise a red-hot issue of what hard country limits will do and there is a fair chance it might be acted upon?

Thanks SGP. Did I read this correctly ? you switched in 9th yr of h1 ? was ur I-485 pending or did u have EAD to change ? I just have I-140 approved. so if I change to a new job now, can the new employer use this old I-140 for extensions ? can new employer ask USCIS to port old priority date ?

First of all, you dont have a binary choice in the matter such as either you learn 50,000 words and their spellings or go smoke dope. There is a middle ground here.
Secondly, why do I see in company after company, especially in the knowledge industry that a straight A student, like your Kavya here, working for a manager who had been a B- student who in turn works for an executive who was a C- student ?
Get educated ... that's fine. But dont get over-educated such that you are a cripple who cannot think outside the box. Too much education, too many straight As, too many spellings will make you incapable of thinking outside the box, taking risks. Anyways, that's my belief and my opinion and everyone is free to raise their kids in whatever way they deem fit. I for one, would never ask my 2 children to participate in any spelling bee contest.

If one thinks that just because someone is a manager over others, that makes that someone better and more successful than others, and if most B- students manage A+ students (which is fuzzy maths), yes, in that case it maybe that its better to get a B- grade than A+, and there is no need to go to business school either. If the world view and the objective is not just to become a manager or make 100K instead of 120K, but actually do something worthwhile in every stage of your life, rather than just having an objective of becoming a manager, maybe its about learning a language and words, then why not. Strong vocabulary is the first stage to clear expression and clear expression is the corner stone of a successful and satisfying career, including bring a manager. I don't see anything wrong with learning more words, or loving parents or obedient children. Everyone has a different age in their life when we revolt against the environment, just to break free. Its not necessary that one must continue to revolt an entire lifetime to be creative or be better than others. Bill Gates or Steve jobs never wanted to become just managers, they wanted to re-invent the future. College dropouts, but successful. But how many Gates and Jobs do we have? I guess there is no clear definition of success and different people gauge success differently, but most people, more so in this crowd on this forum, relate success to level of education/university (US masters or Bachelors from India), and title at work place. But maybe the key is not how others gauge your success, but how you gauge yourself. Maybe you have set your eyes on squeezing most number of lemons or maybe being fastest eater of a water melon, or climbing on top of rhinoceros back, whatever it is, if you have done it and you feel satisfied, you will see yourself as successful. I agree with jonty and nixtor...that was the point I put out as a counter during our discussion. But the underlying sense is similar to what is there for illegal immigration: border fence. Humanitarian grounds is not an excuse you could use it with Congress men and women. Revamping Maths and Science in US schools is the exact justification against highskilled_immigration. Just like the border fence for illegal immigration, I wonder the issue in waiting against our efforts for fixing retrogression of highskilled immigration would be 'Show US born could start their training and educaction first' ...

Hi everyone.
I was part of the San Jose rally .. where there were about 300 odd people.
My neighbors had been to the immigration rally in Washington(flew from San Jose) and they said that there were about 1000 people there.
I have been following the immigration issues for sometime .. and I'm not very convinced that such small numbers can make the difference.
Silicon Valley has maybe a 100,000 Indian engineers or more. Add families .. and a much higher number. Add Chinese and European immigrants .. and you have all of Silicon valley :)
We should hold a huge rally say in the campus of some company like Cisco .. or Google(who are immigrant friendly) on a work day .. say Friday lunch time .. and have everyone attend.
Being in Cisco .. you can pretty much get all their employees to attend... which is substantial.
Also have industry people talking in favor of better immigration policies.
(we could hold it in some other company or a common area .. anything works)
Unless we can have a substantial number of folks say 10,000 or more .. I don't honestly see too much of a point.
Even if IV collects a few million dollars .. and lobbies .. it will never have the impact of 10000 people protesting.
We need to see if we can have similar rallies ever month in major hubs like New York, Washington, Seattle, Houston.
Unless we have s sustained campaign and we have the numbers .. I personally do not see things really changing.
I see people being optimistic about 300 folks in San Jose rally and 1000 in Washington. But having been to the rally in San Jose I don't see how 3 times that number in Washington is going to cut it. (Read Logiclife's post ... but we still need the numbers !!)
I'm not being a pessimist .. appreciate all the efforts that IV core undertakes .. but am totally unconvinced of major immigration changes. Looking at something like CIR being struck down .. after being on television for long and being debated .. I think we should get real.

As if things weren't enough complex, today my friend told me one more thing about finger prints. His PD is 2004 Sep EB2, so he called USCIS to know the status of his application. Then they told him that his finger prints got expired (as per them they expire after every 15 months). So they will invoke the notice to get him an appointment for finger prints. They also mentioned if finger prints have expired then they can't process the application unless it gets renewed.
Although this is first hand information, I was very surprised and not sure whether or not to believe the information given by USCIS call center.
The information that my attorney gave me was on similar lines. From what she told me its a good sign that I got my biometric appointment for next month when my PD is current. You never know, its USCIS.

I appllied on May 12 and did FP on May 31, besides one LUD on July 1st, nothing has happened as of yet. I opened a service request but I ma not expecting anything to happen. Mine expires in Oct., so I still have some more time.
