    Legal Immigrants in Limbo

    It is that time of the year again. Immigration reform is in the air. Recently, there were raids on many businesses and the resulting arrests were given wide publicity. The Bush administration is showing its zeal to pursue the 'illegal immigrants' and 'Undocumented workers' and enforce the immigration laws. The pro-immigration and anti-immigration organizations are ratcheting up their activities. One of the common refrains of the anti-immigration groups is 'If they want to come to this country, let them come legally'. So let us examine what the people trying to immigrate legally face.

    A significant number of the high skilled immigrants who immigrate to the United States are categorized by the existing immigration law as 'Employment Based' immigrants. We would refer to this as the EB immigration in this article. The EB immigrants constituted almost 22% of the total immigrants to United States in year 2005. The EB immigration process consists of four steps. There might be minor variations but the time periods for the processing described in this article remain very close to reality.
    1. Labor Certification - The US Department of Labor (DOL) administers this program. This process takes anywhere from 3 to 5 years. There are people in this queue who had applied for certification in 2001. Now imagine waiting that long for the first step. However, to its credit, the DOL has implemented a new program which has significantly reduced the time required for this process to less than 6 months. However, this program is beneficial to only those applicants who filed after December 2005.
    2. Immigrant Visa application - After obtaining the Labor Certification, the employer petitions the USCIS for approving the certified immigrant for permanent residency. This process can take anywhere between 1 to 10 months.
    3. Adjustment of Status - If a immigrant visa is available, (and there are only 140,000 that are available each year, with a cap of 7% of these per country) the USCIS then allows the immigrant to file for adjustment of status and if approved, formally grants permanent resident status more commonly referred to as the Green Card. It is during this stage that the immigrant is subjected to background checks by the FBI and medical checks by USCIS approved physicians. Currently, the FBI background checks are taking anywhere from 8 months to a whopping two years. Also, immigrants from countries like India and China which are the main source of high skilled immigrants find themselves unable to even file for the adjustment of status because of unavailability of visa numbers. Given the current scenario, it is unknown how long it will take for these immigrants to be able to file for adjustment of status, but it is very likely to exceed 4 to 5 years
    4. Citizenship – Five years after the Green Card is approved, the immigrant may apply for citizenship to the USCIS. At this stage, he has to undergo an additional background check, take a citizenship test before being eligible for approval.

    As can be seen from the description above, the whole process can take 5 to 10 years just to obtain the Green Card and an additional 5 years after that to obtain citizenship. There are people waiting to be sure of their status for even more than that. Given the uncertainty and lack of action from Congress to address the backlogs, some of the EB legal immigration applicants have come together and formed the organization http://immigrationvoice.org/. The goals include reduced waiting time for green card applications for EB immigrations, increased numbers for employment based green cards and ability to get certain benefits if the visa numbers are unavailable.

    Let me make clear what this wait entails. When you are working on a work permit like H-1B, your employer sponsors you for a particular position in the future as a part of the EB immigration process. What that means in reality is that your employer cannot promote you even if you are capable and the employer is willing. In the convoluted logic of EB immigration, if you get a promotion you have to start from step 1 again. That means you are back at the end of the 5 to 10 year queue. Also, spouses of the applicants are not allowed to work even if they are qualified until the primary applicant can file for adjustment of status. Now keep trying to explain to your spouse to keep his/her career on hold for 10 years. The net result of these impediments is that a large number of these people prefer going back to their countries of origin or other countries that offer easier and faster ways to obtain permanent residency and citizenship. That is a big loss to this country.

    And this is just for high-skilled and skilled workers, so our question and challenge to the anti-immigration lobby is ‘Are you willing to put your money where your mouth is and pressure Congress to pass a Comprehensive Immigration Reform to ensure that people can immigrate to the United States legally in a reasonable amount of time?’

    United States is undergoing an unprecedented change in demographic situation. The Baby boomer generation consists of 77 million citizens born in the years 1946 to 1964. The leading edge of this generation is entering their 60s in 2006 and a large number of the baby boomers would start retiring soon. This is a double whammy to the US economy. Even now, the employers ranging from small businesses in the north-east to big corporations like Microsoft are facing serious labor shortages. When a large chunk of US labor force starts retiring every year, businesses are going to be even more hard pressed to find suitable workers. At the same time, the demands for social services from this large retiree population would keep growing. The US economy would find it harder and harder to support an ever larger population in need of Social services support. Unless something is done to deal with the coming labor crunch, United States is facing a huge economic and social services meltdown. The businesses would either fold in face of global competition or go where they can find labor that would allow them to be competitive leading to additional job cuts in the US. The immigration policy this country adopts would determine the future of this country. The only solution to deal with the labor crunch is to allow more employment based immigration.

    As mentioned earlier, the total number of Employment based immigrants allowed per year by current law is 140,000 and it also includes the dependents of these immigrants. This limit was established in the early 90s when population of United States was smaller and a lot younger. This number has to undergo a sharp upward revision to account for the coming demographic challenge this country is facing.

    The current immigration law has rules that prohibit immigration from any country in excess of 7% of the overall immigration. As far as employment based immigration is concerned, this limit is of 7% is illogical. Skills are not evenly distributed in the world and companies do not hire people based on the country they come from but for the skill set they possess to get the job done. As president Bush aptly described "It makes no sense to say to a young scientist from India, you can't come to America to help this company develop technologies that help us deal with our problems". This cap of 7% has caused the applicants from large countries like China and India to wait for years on end. As we all know, these countries are undergoing rapid growth. If the United States does not make an effort to retain this valuable human capital, those countries are going to benefit at United States’ cost.

    Every year, thousands of students from various countries come to the United States to pursue higher education. In a fairly large number of cases, the universities and various endowments provide financial aid to these students. It would make sense for United States to make an effort to retain this talent that has been educated in a large number of cases by the American taxpayers. It is a reality that the talent is sorely needed. Abolishing the country limits on the employment based immigration would make it easier to retain this talent and help ease the skilled labor crunch.

    The USCIS has serious issues in dealing with the magnitude of immigration benefits processing expected of the service. The Bush administration has made some not entirely successful attempts to improve the workings of the troubled federal agency. The United States does not become safer if an immigration benefits application sits entangled in a bureaucratic nightmare for years on end. The USCIS should be mandated to process all existing backlogs in a reasonable time frame and provided the resources and leadership to accomplish this goal.

    In the cacophony of anti-illegal immigration rhetoric, no one seems to be paying attention to the plight of the legal immigration applicants waiting for years for their applications to get processed. The United States is supposed to be the land of opportunity. The Congress should make an effort to ease the hardships of the people who have followed the law and are trying to immigrate legally so that these deserving immigrants also get a chance to pursue their American Dreams.

    If the USCIS cashes the checks and then returns the packets (total $1490 in my case), is there any legal recourse to get a refund from them? Since they are pretty much doing whatever they want, this thought just occurred to me.


    I don't think they will cash any checks. They know at least not to do that.

    After you wait for 7-8 years in your category for your visa your thougths will change. I have MS from an american university + work experience. Our lawyer decided to file EB3 in 2001, they convinced the company that EB3 is easier to get approved. i am still waiting for my GC, in the mean time i have gained a lot of experience, i am still an EB3 for USCIS. There are many in a similar position.

    People talk about unethical practices etc. i feel that they ones who jumped the queue and used agressive lawyer already have their green cards. Most of my friends are already thinking about citizenship (and ROI after USC..that is a different forum :)).

    Its people working in multinational companies who follow the law by the book are the ones who get screwed, its just my observation and opinion ..good or bad, i dont know...


    When there is a overflow, I strongly feel that it should flow to all the categories and that is called equality. Some inefficient people in Decision making authority at USCIS framed a rule on visa overflow and they are following it. If the rule is not much logical/ethical to most of the people, then anyone can voice their rights against it.

    Just for example, a team consists of one project manager(EB1), two tech leads(EB2) and 6 Developers(EB3). The demand is based on no. of vacancies exists on the market, that means a lot of EB3, less EB2 and few EB1.
    As per this rule, USCIS is not actually feeding the hungry.
    Regarding the country quota, US is not favoring/helping the foreign countries by giving GC to those people from them. So, it makes no sense at all when it comes to immigrants but I can understand the bureaucracy behind it.
    If they are implementing the country limit then it should be like 0.00001% of that country's population, I feel.

    Hello,

    i am lawful permanent resident. I want to bring my parents here permanently. I got nobody in India to take care of my parents.

    When i was small, my parents took care of me. When i need them, they are their for me.

    Now my parents need me. But i am not their for them. I feel very guilty and sad. I want to bring my parents in US. So i can take care of them.

    How can i bring my parents permanently.
    I know, i can bring them after i get citizenship, that is too long wait.

    i just want to bring them now. So they can have good life with me. Anybody know, how can i bring them in US soon.

    i saw some petition signed by many Indians for this request. Can somebody please go forward with this.
    Current president will understand our request and help us. He is very nice and kind person. He loves family and his mother in law lives with his family. He knows values of grand parents.

    Indians live with family, that makes Indian family stronger and less divorce. And Indian kids are well taken care by grand parents. So they are well behaved and best kids.

    We need this permission. Please work together and get this permission.

    I read this in a website. Is this possible? I want to explore all possible steps.

    It was current for July. so i mailed my application on june 29, 2007, expected to reach USCIS on july 2nd, 2007.

    first of all congrats. but i have a question.

    you said you are EB3 ROW (Bangladesh) but you applied your I-485 on June 29, 2007 with a Priority Date of Feb 06.

    But on June 2007 (just before the VB fiasco) the Visa Bulletin for EB3 ROW was caught up to June 05 (http://travel.state.gov/visa/frvi/bulletin/bulletin_3236.html). But your EB3 ROW PD is Feb 06. So how is that possible?

    Only EB2 ROW is current. Are you sure you are not EB2? You can confirm this by looking at your 140 notice. Otherwise you must have sent out your application June 29 (Fri) in the hope of reaching USCIS by July 1 or 2 (Sun or Mon). That's the only way I could make sense of this.

    Either way man, your stars must all lined up or something man. You are indeed very lucky.

    the reason I am pestering you is becoz I too am EB3 ROW with PD of Mar 06 and I filed on Aug with an approved 140. I am now kicking myself for not mailing out June 29 Fri.

    I am guessing that either you are IV core or very close to it.
    so can I just ask ... is IV planning any campaigns at all in the near future (i.e. in the next 2-3 months) ?

    At this time we have request for interview from over 7 highly reputable media outlets including NPR Marketplace, NY Times, LA Times, AP. We have asked members to interview if they feel anxious about the current state of the affairs. Can you guess how may responses we have recd till now? Is this not part of the effort/campaign? There are few members who will spend whole day discussing sending pizza or fight over tracker data. But we struggle to find sincere members who are ready to interview with the top media outlets. This indicates to us, either everybody is extremely comfortable with wherever we are and no one is feeling the pain, or just 2-3 of us feel the anxiety due the economic slow-down. If over 30 members can discuss for a period of 3-4 days about sending pizza, and the objective is to attract attention for our provisions, then is it not possible to achieve the same with the available media opportunities. Getting media opportunities is a difficult job. And its extremely frustrating to see lukewarm response to the action items and request for help from the members. Please understand that there are many aspects of our advocacy effort. We may be focusing on a specific aspect at a particular time, and its possible that you want us to work on something else. It doesn't mean that we are not working on a specific campaign right now. So I am baffled by your question of doing a campaign in next 2-3 months.

    It is possible that next month we may see new bill from Sen. Grassley and we may have to re-adjust our effort to respond to such a bill. Political events are not predictable, but we have to respond to every developing situation. We are always very sincere in the community effort, so I request to please support the effort, even if you do not agree with it 100%. And please participate in the action items, because they are always part of planned activity and is not an abrupt absurd idea.

    Campaigns are not based on a specific provisions, even when everyone of us sees it in that light. Provisions are the end product of every campaign. But to achieve our provisions, there is a long drawn process, which includes multiple stages. I am not able to list all the stages in a single post. But I will encourage you to see this document -

    If the legislations dont change - my estimate would be even more than 7 years (come on they already have 500k pending app before this 300k July2nd boom). In USCIS term It doesn't matter where you stand in line out of that 800K folks. The NSC july 2nd filers are speculated to be transfered to TSC almost 2 months down the line and no one has guaranted that our Original Receipt date of July 2nd be kept intact - How do you logically map this ??

    Well, I don't think I am at the end of line of 300,000 people. There must be lots and lots of people whose priority date is after April 2004 might have filed. This includes 2004, 2005, 2006 and 2007.

    So I think 3 years is intelligent guess. But who knows I am just trying to make myself happy and trying to stay positive.

I just started with a simple question "WHATS THE MOTIVATION FOR CONTRIBUTION(MONEY AS WELL AS TIME) FOR PEOPLE WHO HAVEN'T APPLIED FOR GC " !! Was that offensive ?     I completely agree with you. However our problem is 'how do we organize a massive protest". IV is a loose affiliation of people affected by the immigration problems. They all realize the importance of fighting, however majority of them are unwilling to contribute personal time/money/energy for this cause. Flower campaign was first time in recent history, when legal immigrants showed some unity to express their anger and frustation.

    It was predicted that once 485 is filed, people have EAD, and spouse working ... affected people will loose the apetite to carry on the fight. And that's what precisely took place. The biggest chellange is to let the affected people realize that if they do not come out and fight, no one will take care of their interest. It seems everyone is waiting for others to go out and fight, so that they can reap the benefits without any struggle. Now tell me my friend "how do we organize a massive protest??"

    excellent analysis. After the flower campaign, and during the rally, IV formed state chapters and state chapters have been designed in such a way that efforts can be organized in an effective manner.
    There is always some activity or the other going on in the state chapters, in fact in our chapter we organized some law maker meetings in DC this week and some members attended the meetings.
    Lobbying is a very effective tool and the more the numbers and support, the more effective lobbying works out.

    I would strongly recommend that the members join their respective state chapters and organize grassroots efforts.

    Unless we help ourselves, no one is going to help us.

    The earlier who mentioned about hard hitting a car on Tree/building to shake the robber and run away is absolutely misleading peoples. There is no reward for bravery or mental sharpness in US for folks who wins a fight with robber or outsmarts them.

    How much the Robber can steal from you - Couple of hundred cash, 5 credit cards ( which you can immediately cancel if you are not injured) and some important contacts. Be Nice with him and give him what he wants, tell them that you understand their situation and be sympathetic and polite with them.

    I once did that and the robber just took 20 bucks from my wallet, 3 Marlboro Lights cigarettes and returned me the rest of money,credit cards,my SSN card and important contact papers and my rest cigarette pack and told me "you look like a nice guy".

    Don't panic seeing robber or don't make the robber panic by shouting or banging your car on the building :) Robbers are just human beings like us with pathetic economic conditions ....

    So you want a Greencard? Before you are too old to actually do something with it?

    You've worked all your life to get something decent back. Went to decent schools, worked hard in your 10th and 12th grade, earned your bachelors. Now what?

    "Hey, Look, US is hiring IT people". 24 hours of flight. You land in America. Life is one sweet deal. You are making money in dollars. Japanese cars. Japanese cellphone. American salary. Italian food. Camcorders. Big Screens. Nice laptops. Las Vegas. Cruises. Pride in work. Pround parents at home.

    Life is swell.

    But then its temporary. You need green-card to make it permenant. Then our of nowhere, the word "Retrogression" hits you and ruins your party. You start praying. Look at visa bulletins. Make sure you stop browsing too much internet at work and start working harder to make sure your project lasts longer and you can keep extending your H1s forever.

    There is ANOTHER WAY. Its called REACTING to the problem by DOING SOMETHING ABOUT IT.
    People like you and I, who have lost our sleep due to retrogression have gathered together and joined hands to pool resources and hire a professional lobbyist to help push legislation in congress that will raise EB Greencard quota and allow you to file for I-485 even if priority dates are not current.

    Go there. Read the mission of the org. Its non-profit. Its free to join/volunteer and contribute your thoughts. See if its something you can relate to. If you feel comfortable and can trust, then contribute money. If not then you can still post on threads and forums and contribute your thoughts and give ideas. It still beats sitting and doing nothing about something that hurts us so much. After all that you have been thru, why stop now and sulk? Why not act?

    msgs like this help establish the notion that this is an indian website dedicated to indian immigration issues. I didnt see any post wishing happy Eid/ Eid Mubarak nor did I notice last year that anyone wished a Merry Christmas/ Happy Holidays, nor do we wish our Chinese friends a Happy Chinese New Year.

    Dude - my perspective changed after I started living in New York City. Last week we attended a diwali event and it was just not Indians there but all nationalities were present there and everyone were greeting diwali wishes.

    I lived in Bombay for 10 years and we celebrated every festival like Durga Puja, Holi, Christmas, we used to have Ramadan fast break lunches and everything.

    Living in a cosmopolitan society, one must celebrate and respect every culture and their festivals. Thats the only way to achieve unity.
