It will likely be small, but it may become the "king maker" one day and have a real influence on policy. An example is the "Action Democratique" party in Quebec. They are mainly Gen-Xers which means they are almost all under 40. After decades of seperatists and Liberals dominating Quebec, they had had enough and now they are the official opposition after ten years.

You dont need an EAD, if you still have valid H1. AC21 has nothing to do with EAD. However, if your H1 is expiring soon, and you have already used up 6 years of H1, you would need an EAD, because H1 extension beyond 6 years is available only for people who cant file I485 because of retrogression.

I'm hoping to get a receipt notice soon so that i can file for EAD without the increased fees. Anybody has any link to where it says we don't need EAD for AC21 so i can check with my lawyer?

If you were not told the correct bill rate, you can recover that money. Simply ask them in writing to show you the contract since you are on 70/30 basis. The written contracts, oral contracts, emails all stand in the court but how will you prove an oral contract? If you have found an offer that meets your expectations just quit. We all make the same mistakes. We spend our time on working out things where they are not working. Just "quietly" without your employer getting a hint, find a job and quit.

Maybe you guys want OP to go to DoL so that both the employer and OP get kicked out of this country (that is good for all of us) due to obvious immigration fraud.

This site should not promote illegal behavior, anybody seeking advise on these topics should be severely castigated, because they broke the law too (and they know it, just dont want to admit it). Yes, that is perfectly correct. If an employer needed somebody with BS and 2 yrs exeperience, and no US person applied. You (with a BS and 2 yrs experience) applied. Employer filed your I-140, which is approved. Now you wait for 4 years, and in the meantime you get your MS. Technically, you are now overqualified for the position, and employer may decide even not to consider you any more (leave alone upgrading to EB2). Note that entire process is for future employment after you get your GC, until then if you are working, you are working as a guest worker.

I agree, if you are past 180 days since you applied for 485 and if your 140 is approved, it shouldn't matter if your ex employer withdraws 140 now, though I doubt he would.
This is another example of a bad desi employer trying to screw an employee. these stories make me puke. the employer did not have a problem when you found a project, when you negotiated rates and when you worked with the same client for 3 years and now all of a sudden he is holding you accountable. totally unprofessional . sic.

How do you think the passage of the DREAM ACT could impact our situation ? If they pass this, they would allay a sizeable portion of illegal immigrants to get amnesty through their children (few millions). I am just wondering whether the illegal alien supporters would lose steam to support CIR after this ? Ironically, they would get a sizeable amnesty, overhelm USCIS with millions of applicants and probably make the passage of a CIR bill more distant. I can't think of something less advantageous to us than this. I hope I am totally wrong.
What do you guys think ?

Bush has been espousing all along the cause for comprehensive reform in this area. Most people recognize that there are immigration problems and governmental delays that exist. Most also believe that the system needs to be changed for the better. But just how this should be accomplished is not so easily agreed upon, and so it is a hot-button issue. Many of the hardliners, who took a strong anti-immigration position, lost the recent elections. But there are some who took this stance and won. It also is widely believed that many of the newly elected Democrats expressed anti-immigrant sentiments in their campaigns. Achieving any strong pro-immigration measures may prove to be more daunting than originally was anticipated; certainly more than many hoped it would be. Needless to say, we can expect 2007 to mark the beginning of a time for change and flux in the arena of U.S. immigration law. There is a possibility the DREAM Act could be passed, allowing the children of undocumented immigrants (who complete their high school educations in the United States) to obtain conditional "green card" status if they enroll in college or join the U.S. armed services. I was in the same situation recently for the State of Iowa. My attorney called up the DMV and explained the situation. The DMV informed him that they would need the receipt notice from the USCIS. The license will be issued for the lesser period of the time range (if any) mentioned in the Receipt Notice that the USCIS expects to take to decide the petition. Upon receipt of the approval, the person will need to go the DMV again with the I797A form and get a final license.
Fortunately, I did not get to jump through the hoops as I decided to spend some hard earned money and got my extension approved by premium processing. Anybody else who has done something similar please post.

You have a little tricky situation at hand, but you'll be okay if what you wrote is true - Your employer will not revoke your pending I-140. Not only that, they have to be nice enough to respond to any RFEs that come for your case. they can state that the imimgration application they filed for you is for a future position.
Also, USCIS has a guideline about these cases. They are supposed to see if your I-140 was 'approvable' if it had been adjudicated within 180 days or before you leave the company, which I think it should be.
I understand there are some anxious days ahead for you, but If I had to bet, I would bet on successful result of your case in the end :).
Just make sure that your old employer doesn't revoke your I-140

I assume you might have gone to Rt 23 DMV, try Rt 46 in Wayne. They are more considerate. I had my DL expiring in April 07 but my H1 was Valid till Sep 07 (the DMV officer had a made a mistake in 04 by putting the wrong experation date when I went to update my DL with Motorcycle endorsement. When I pointed this out he said I still have almost 3 years so come back then:mad:) . I went to Rt 46 Wayne and the lady renewd mine till Dec 07. 90 days more than the valid dates on H1. She said she has already included the grace period which is avaliable in situations of visa renewal so I can renew my visa and get back to them in time. This shows that there is a provision for 90 day grace period.
Try Trenton if Rt 46 in Wayne fails. Best of luck.

After multiple requests to my employer, i finally was able to get a scanned copy of my I-140 approval notice. It's just the approval notice and not the original I-140.
My questions is, is that enough to port my PD in case i want to change my job and switch the company??
How can just copy of 140 approval enough. In order to port I think you need job title and description...

Looks like 25% of those still waiting are in 2005 - this blows away the earlier predictions that the dates will advance quickly through 2005 - looks like pre perm cases are considerable! I was hoping that it would reach my PD atleast in Sep 2010, but now, it looks only 50-50 chance (dont ask me how i arrived at the 50-50 number, just pulled some numbers from the air :) )!
