Chandu, my question is not whether HR dept can handle it properly or not.
My intention/question here is if an applicant is on H1 (most of the cases 5th or 6th yr of H1) and then loose the job and until he finds other job (has EAD but never used it) the applicant does not have payroll running during the break. then technically is he ok or does he has to maintain h1 status or does EAD protect him.
Coz until he finds a job and files for AC21 an applicant does not do any thing.
And what do you mean by satisfy AC21 criteria. unless you find a job you cannot file AC21....so during the gap (what is the status of this gap?...technically I am trying to find an answer. please point me to a link or document. If you are aware of it, else can IV find an answer to it)

EAD IS NOT A STATUS. EAD is given because you filed 485 and you are pending AOS, so you are permitted to stay till a decision has been made

If they'll have to wait for 8 years, within this time will they have to-
a) work for one employer while their GC is being processed, like we do.
b) ask the employer to pay $1500 fees to hire one of them, like our employers have to, for us?
c) have to wait for hard country quota to be current (in which case Mexico will retrogress a few decades)

Its simple. If your priority date is <Year> then you wish it to be in <Year> and you predict to be so and say that the rest of the categories will not move.

Ya know what? I am so SICK AND TIRED of our lawmakers bowing down to those illegals, who don't contribute anything to our society. That's right, NOTHING. They steal the jobs that Americans WANT to do, and our lawmakers just bend over and lick their boots!

My question is

1. I apply for i-485 now.
2. get married and bring spouse on h4 and she remains on h4
and my I485 is approved before the PD is current so spouse is out of status for a short while before she can apply for AOS?

What was really pathetic - dependents of L1 visa holders were allowed to work, whereas dependents of H1 visas - the H4s, were not!
All they're left to do - if they don't qualify or have any interest in a high-tech field - is to listen to frustrations of their H1-holder spouses about this whole immigration mess!

I totally agree with Arunmohan- We H4's are not considered basic human beings here, we are not allowed to work ,may of us experience difficulty in getting a drivers license, we cannot have an independent bank account- literally we are considered as without life. unless I am egregiously mistaken, I 140 is totally employers and not employee's. How can you invoke FOIA on that? I mean freedom of info doesnt mean a breach of privacy or disclose "compny/personal" documentation.

I have many times pondered on the strength/power of dollar value and I feel apart from factors like globalization/petro dollars most important factor is America's politics.
No matter who is in the White House, no matter what their domestic politics are, no matter what their agreement(s)/disagreement(s) are they follow a well established strategic template on the International arena always keeping their focus on fortifying their super power status/dollar strength.
Very fact that dollar value is not as low as it should be amidst the current crisis shows the value that dollar is enjoying(when compared to the value of the currencies of other economies that didn't actually collapse as did American economy) may not be the real value but a strategised value.
Watch this video on globalization (if you have not already watched as it was shared on this forum twice) though it's a bit long and seems like exaggeration at few spots(speaker himself says he may be exaggerating or something like that..) it helps one understand few things.

If USCIS works round the clock, working all 200 days of an year, atleast giving green card every day for 100 applicants then from now 3 to 4 years is really optimistic and certainly possible . But I'll say better for to says atleast 5 years from now.

It was a great meeting. I was blown over by the enthusiasm of the folks. It was intended to be a casual get together, but beyond a point it became more serious:D We did have action items and we will communicate it through emails, we cannot post such things on public forum. We are working on the next event planning once we finalize the place and time we will get in touch with U.
can you hold these meetings on saturdays? weekdays are impossible for me with a 1.5 hr commute (common with most tri-state folks).
informal get togethers can be held at the flushing hindu center on sunday evening, at least for those who are hindus living in queens. (the majority here, i guess)
