We me and my husband took infopass on 95th day of reciept date
(11/28/2007). The USCIS officer was not that friendly, but she promised to send an e-mail to main office. The very next day (11/29/2007)we had an update on website that EAD cards were ordered and we got it today. The date on the cards was 11/29/2007. It worked for us. It is really depends on the officer you speak with.

From the same memorandum:
"Accordingly, if the employer withdraws the approved Form I-140 on or after the date that the Form I-485 has been pending 180 days, the approved Form I-140 shall remain valid under the provisions of �106(c) of AC21. It is expected that the alien will have submitted evidence to the office having jurisdiction over the pending Form I-485 that the new offer of employment is in the same or similar occupational classification as the offer of employment for which the petition was filed. Accordingly, if the underlying approved Form I-140 is withdrawn, and the alien has not submitted evidence of a new qualifying offer of employment, the adjudicating officer must issue a Notice of Intent to Deny the pending Form I-485. Does any of you trade in Indian shares? If so, did you have to open the PIS NRE account to do trading in Indian shares ? I heard that NRI from USA can not use the normal demat account to do the trading in secondary market in India.

We hope the President will squarely address the public's frustration with a lack of workable solutions on immigration. He must place this frustration in context - lack of federal action leads to growing impetus in the states to pass laws, no matter what their cost, simply to try to resolve the impasse. The President should address this frustration, but should also address the undisputed polling that shows that Americans want comprehensive immigration reform. This can be his moment to bring people together by laying out a framework that will actually move Congress to complete workable legislation.
We also hope that the President avoids some of the typical election chatter on immigration, which tends to turn the issue into a political contest of who can talk the toughest. Rarely does the debate move beyond the issue of further fortifying our southern border. While border security is a necessary component of comprehensive immigration reform, we cannot stop there. Real reform must look past campaign politics and find solutions that will allow communities to live and work together without the anger and recriminations that have dominated this issue for years. Over the last year, the President and his administration have expressed a willingness and desire to pursue a comprehensive reform strategy. Is there any information on what an "easy" case is?
I haven't seen one so far!
It appears, easy case is a subjective decision made by a USCIS worker based on amount of time needed for the case.
It is a job scheduler that schedules the shortest job first with a subjective estimate of the time needed to process the case.

And we need to do some high-profile lobbying. Like get the big companies involved. I hear these big companies have their own lobbying manager (Google has them) working full time. And they have deeper pockets than our $20 or $50.

My PD is september 2006, I140 approved, DS230 approved, 3 packet approwed or not ( I am not sure, accordig to the last reply from the attorney my case could be even in the consulate), Before the retro began my case used to be a subject for schedule "A"( nurse), now I am in EB3...
The question is - will I receive my appointment to the interview soon(next month), because all forms have been accepted already, or I have to wait for all cases with PD older then mine to pass before my case???
One more question.
I am not in the US. Should I try to go to the US, and then(after 2 months) apply for I485, before the retro will start again in september??? Is it necessary to have I485 approved in order to receive legal status or it just have to be filled and applied? Will I lose my place in the consular processing after applying for the adjastment of status?
I know , too much questions, sorry for that but I am realy confused, and badly need your help and advice!

Hello To the IV Core Committee,
Thanks to you all for the tireless efforts in pushing the immigration reforms forward .
I just wanted to take this opportunity to give my thoughts on this important Bill HR 5882 that is due for hearing on the 23 Sept'2008 after several postponmetns / adjournments.
I guess that we are fortunate that our Honbl Prime Minister Manmohan Singh is visiting the USA during this week and is scheduled to meet the President George Bush to discuss various issues related to US - Indai Relationships / businessess etc.
I feel that if the IV Core committe makes use of this golden opportunity to meet up with our PM and request him to also discuss on the pending immgt bill that would help several of us.
I'm not sure how best this advise of mine sounds,but i think there is nothing wrong in trying out.
Hope the IV core committe consider this view of mine.
Thanks again to one and all and in particular to the IV folks.

There has been established a way to deal with backlogs at Dallas and Philly, and these officials at PBEC and DBEC have been given a deadline of Sept 2007 to clear everything. So someting is and will be done in this regard. Not much more can be done here with PBEC or DBEC, and the real test is to get solutions for the retrogression.
Once the laws are passed on the immigration reforms, its a done deal my friend, and then it does not matter how much we try after this to address retrogression. This is our only chance.

Tell me about it. My wife didn't have a fancy law degree but she had a decent job before we got married and she came to US. She doesn't have any specific skills that will qualify her H1b but she has a MBA. So there isn't much she can do in terms of furthering her education. So she's been stuck at home for the last 4 years.
I have been now for 7 years and still waiting... my wife who graudated law with top honors in a top university in india and was pracicing with a leading corporate law firm joined me in US and to make it good we spent around $65K on her law school graduation here and then another 15K on bar exams preparations for NY and CA. She managed to pull through all this. we decided to have a baby and take care of her wihtout day care the 1st 2years. now my wife sits home since she cannot file a H1 though there are willing employers becuase she has stayed here for 6 years on h4 and my llabor filed 2001 was still in BEC.... what can i do... i left a Director job in fortune 50 company and joined as consultant so that i can make use of a pre-approved labor, then another regression happend and i am still waiting to file 485. I just want to let my wife to work for a couple of year and make use of the effort she spent in her US law school and bar exams and want to return back to India.... but when can i get that 2 years.....

I am following from the start of the original post. This was a post by a new member who appears to create rift among the EB2 or EB3. The reason I believe is he just want to incite in such a way that few other folks will respond and keep the thread floating. Later few other posts by himself were created with different ids. just observe the trend and you will notice it.
So folks dont respond any more and this rift creation will die down.
I hope the admins keep this thread open and not kill it. I am not sure what the intentions of the OP ( some of you claimed that he wants to create a rift ), but this is definitely a valid concern for all the EB3(I) guys. This is a natural reaction to the frustrations of EB3(I) guys just like the mass upheaval during the July 2007 VB fiasco. Since it was across the board, there were no differences. Now since this involves only EB3(I), there is not much support from IV or others. But in my opinion, this is as much unfair as the Julay VB fiasco.
Some of the EB2(I) guys are worried that their GC dreams would get delayed if there is any Admin fix for EB3(I). For all those individuals in EB2(I) who want to oppose any kind of admin fix for EB3(I), I just want you to think about it. Is it really fair? There are individuals in EB3(I) waiting since 2001 - a total of 8+ years. Don't get me wrong - but some of the EB2(I) guys who have applied as late as 2006 and 2007 are expecting/hoping to get their GC this year if there is a spillover. And I think these are the individuals ( not all of the EB2 guys though ) who are opposing any kind of admin fix ( please dont yell at me or curse me etc...if you are not one among those mentioned, then please dont worry..this is not about you::) Ofcourse i would like each one of us to get GC as soon as possible) to EB3(I).
And I dont see why there will be a rift between EB2 and EB3 if each of us follows net etiquette in positng responses. Let's do some constuctive brainstoming - without getting into perosnal attacks or getting too emotional. Let's do what is right and not what each one of us thinks is right. Then I guess there wont be any rifts. The only thing I am asking is to get EB3(I) to advnace a little bit. I am not asking for it be on par with EB2(I). I hope some of you see a point in my frustration::))
Do you really want EB2(I) to advance to 2005/2006 while EB3(I) guys are still languishing in 2001? That's totally unfair in my opinion. I know this world is not fair but how can anyone else try to divide us if we all stand united? And to stand united, EB2 guys should be willing to support any initiative to help EB3(I) move from stone ages::))

And I dont see why there will be a rift between EB2 and EB3 if each of us follows net etiquette in positng responses. Let's do some constuctive brainstoming - without getting into perosnal attacks or getting too emotional. Let's do what is right and not what each one of us thinks is right. Then I guess there wont be any rifts. The only thing I am asking is to get EB3(I) to advnace a little bit. I am not asking for it be on par with EB2(I). I hope some of you see a point in my frustration::))
Do you really want EB2(I) to advance to 2005/2006 while EB3(I) guys are still languishing in 2001? That's totally unfair in my opinion. I know this world is not fair but how can anyone else try to divide us if we all stand united? And to stand united, EB2 guys should be willing to support any initiative to help EB3(I) move from stone ages::))
