For upper middle class, OBC shouldn't matter much since you can afford to enroll your children in private schools and have them work in private sector once they reach an appropriate age. If they are US citizens, they can come back to the US anytime for education and/or employment.
Talking of reservation and discrimination, what legal immigrants are facing in this country is not much different in my opinion. You can't even get your driver's license easily, let alone permanent residence. Most of us are here by choice even though we face all these issues in our daily life.

We have worked hard in the last 4 years and have made some progress along the way Immigration Voice Achievements (http://immigrationvoice.org/index.php?option=com_content&task=view&id=5&Itemid=47) But Most of us are still in the limbo of green card process and waiting in different stages. Some of us may have advanced to the I-485 stage and have a little more career flexibility but the hanging sword of uncertainty still looms over our heads.
Our angst, our insecurity:
Even with EAD and other options, lack of green card is lack of security and lack of certainty. You know it and you feel it every day. In order to find a permanent fix for the uncertainty, angst and insecurity and in order to snap out of the probationary lifestyle and career, we have to finish what we started over 4 years ago -- get the U.S. Congress to act on this problem and solve it once and for all.
Early effort wins:
The first agenda of next Congress will be immigration and we expect an immigration bill to be debated sometime in early 2011. However, it would be a big mistake to wait until that time to do something about that bill. Successful advocacy efforts are the ones that start early and introduce concepts and ideas into the debate before the legislators write their first draft. Once the committee hearings and debates begin, it is harder to get changes or fixes into a bill because it requires an amendment to the bill in a politically charged and heated atmosphere. Groups and organizations that wait until the last minute to influence members of congress often fail to achieve results. In order to succeed in next year's immigration bill, we have to begin talking to members of congress now. Remember, the advocacy efforts we did with lobby day and rally in Sept 2007 influenced congress to include our provisions in bipartisan bills introduced in Aug 2008. Legislative things take time.

Let us talk about EB3-India category experiencing the discrimination against EB2-India. Why there are few EB3-India approvals this FY so far???????.
One of my friend with same PD as me (Jun 2004) got approved sometime in Aug/Sep 2007. His labor was pproved in a month from NH and I-485 was filed long back when dates were current for EB3 India (early 2005?).
It is for sure that there are a few EB3 approvals this FY ? I know a lot more guys with PDs in 2002 and 2003 who got approved.

You mean to say sell US real estate for GC/citizenship? I don't see this going very far. I can see anti immigrants waiting for this one. Best is to lobby using aides of big corporations, developing relationship with lobbyists who already have connections, hiring lawyers, developing strong case, donations in election campaigns etc. All of this needs loads and loads of money. Are we ready to donate to IV and build strong lobbying group for our cause? That is the only way to change our current situation.
Sending flowers, sending pizzas, sending all these proposals will only fall on deaf ears. Congress understands language of money to pass laws, Rest of the country/orgranizations understand language of laws/court.

From what I can gather, from the immigration perspective:
1. If you are on H1 - You can technically start a business but since you cannot "work" towards it, in practice it's almost impossible
2. If you are on H1 and have an EAD - You can start a business. But if you use your EAD, you are no longer on H1. (There are contradicting views on using EAD for PT while still maintaining H1. For now, this is a grey area)
3. If you are on EAD -
a. If you plan to work on your business on a part time basis and stay with your sponsored job full time, I don't see a problem with this.
b. If you plan to work on your business full time, you might have an issue with a RFE at the I-485 stage as you would have used AC21 for self employment (Some people say this is okay, but it depends on your risk taking ability)
Thoughts?

Here is the timeline for folks that are not serious
EB2 India: Waiting for July - October spillovers thinking that most EB2 will be current. The prediction threads have hyped this a lot. Many will benefit this year. But many will miss this bus too. Some from those who will miss this bus, would be back wanting to do something in Nov - May timeframe. Others will waste their time on predictions and trackers and make those site owners rich.
EB3 India: Many who filed in July 2007 are still happy with EAD status. They worry and contact IV only if their I140 is revoked, I485 denied or if EAD renewal is delayed. Some still sulk or want to blame someone (even IV) for their delays. Those who have not filed I485 yet are few in number. Many new Eb3s still do not know the extent of the backlogs. With time they will slowly learn about the backlogs and wait times. When they suffer due to lack of EAD, they will all make noise on IV asking for some action. This is the reason why the I485 filing action item thread is still weak and pre-mature. I would give another 2 years for the non-I485 folks to have retrogression sink in.
Retrogression is not going away. If it goes away, only applicants will benefit from it. And these applicants are too weak and small in number to even raise their voice. So why would anyone pass a law to make these people happy that do not even want any law changed. After 2 years all the folks who are not participating in advocacy days and contributing, will contribute to IV. At that time, if we in core are still around, would rather ask them to lead the effort if they can and if they are really serious. The current advocacy day campaign and contributions are a measure of seriousness for us to plan our next agenda items.

This memo is just a "interim guidance" and NOT a law. That does not make me very comfy. If it is a law, we can always appeal in court. Not sure about an "interim guidance "

In the Yates memo, the 180 day rule is very Lenient , which many of us interpreted or will interpret in our favor.

One filed, it is the application ND that takes priority. For example, if there are two EB2 applications, and the PD for the two are Aug 2002 and Aug 2004, and the ND for these two are June 2006 and Jan 2006 respectively, the applicaiton with ND of Jan 2006 gets priority, provided both PD are current.

with the deluge of filings in june/july and aug. this year....the retrogression will get worse. USCIS will not make the same mistake again.
I see this prediction every now and then. Why don't you guys get your facts straight. Retrogression will remain the SAME. The pace at which they process GC's is not going to change. It's just applications moved from your home queue to the USCIS queue. Why would that make retrogression worse?? Think before you talk!!

I think Wah Wah is confused by the differences between 'retrogression' and 'backlog'. Of course, you are right that the PDs are not likely to go much further back (I think USCIS took a conservative approach after July - note they are still issuing visas to those with non-current PDs but are using the bulletin to limit incoming new filings). However, if 20 million applied in July the coming backlogs would be horrendous, even though priority dates would not necessarily need to go back further.
However, in a sense, if the backlog is perpetual, and let's say the PD never really moves forward by more than, for example, one month, in the next 10 years (I'm picking extremes to make my point) then the effective retrogression at that point would be greater than say todays.
Phew. Anyway, I think that's what he was on about!

1. I have got H-1B valid from Oct 1st, 2007, but I have not started working yet. I am going to India next month and want to come back using AP (obtined thru my husband's GC process). Will there be any problem at port of entry?
2. What should I tell at POE about my H-1B visa? Do I need show any pay stubs or employment letter?
3. Is it better to revoke my h-1B before I go to India to avoid this confusion ? If so, how do I revoke H-1B

Created an SR request : ~ September 20, just got standard email saying Intial Review is still in progress.
We have an Info-pass appointment tomorrow. We chose the 45 day not response option. Not sure if that is ok when we get there.
Is there anything else I need to know before I meet a rep during the Infopass appointment.
We plan to take all relevant documents, along with a copy of email from a conference in Canada where my wife is invited.
Any input will be great.

Those of you who are now thinking that being able to file 485 will give you freedom - just read through the list to see how many 485 filers (mainly Indians and Chinese) are stuck in the name check russian roullette.

Most would think it would catch moslems - in reality it catches anyone in "hi-tech" and more often than not Indians, Chinese and Russians. And ofcourse Koreans too. One of the person's stuck in name check commented on the above link - if the FBI knew that a fifth of the nation shares the last name Kim! I guess the same would go for Wu, Yu, Zhou, Singh, Kumar etc.

EB1 or EB2 or EB3 is created by USCIS. We are just applicants. We were not asked to give our 2 cents to frame the rules.
So there is absolutely no logic for us to fight among self. Target is USCIS. EB2 can raise their concerns, EB3 can raise their concerns or both can do it together. Lets get that straight.
