Can't pick stocks in this Volatile market, but one thing is certain the markets will be volaile for some time now. So I suggest be long Vega. Pick a stock where the implied vol is higher than historical vol (you will find plenty. Eg C) and put on an option straddle. Sure to make money.
This is not a day trading strategy but a derivatives trade.
Please also recommend stocks for tomorrow...

Regarding my I-485 appln. status - I do remember seeing "Request for Evidence" status before. Currently I see "Request for Evidence Response Review". I see this status change although there are no LUDs.

When USCIS sent you the RFE notice, you would have seen "Request for Evidence". After USCIS receives your response, you would have seen the hard LUD, while the header is still for RFE. Then after some days (with in 60 days), the header changes to "Request for Evidence Response Review", while the old header "Request for Evidence" vanishes. I was in the same boat like you. I spoke to my attorney's team and they offered me the insight glimpse of working of USCIS.

Hello everyone,
Here's my situation. H-1B for self and H-4 for wife valid through Jan 2010. However our respective visas have expired in Dec 2006. So we'll need to get restamping next time we leave the country. We intend to travel to India this Summer from May through July. Ideally we would like to get the stamping done then during our stay in India. However there is a complication (isn't there ever) since my wife has an employer willing to sponsor her H-1B (starting in Oct 2008). I heard from the gurus here that this will be a COS from H-4 to H-1B and it is strongly recommended not to travel when a COS is pending. I think my options are as follows :
1. Get H-4 visa stamping in India in June while there. Assuming we do a premium processing for my wife's H-1B in April and travel to India after the decision is made (say by May), will there be any problems getting the H-4 visa stamping for my wife in India since we want to return in July before her H-1B starts in Oct?
2. The other option is to get a new H-4 stamping done before applying for the COS in April. This will be either done in Canada or Mexico I guess.
3. Another option is to straight away get the H-1b stamping for my wife in India instead of H-4 but that will cause her to wait in India through October which we would like to avoid.

Can you please let us know the procedure? I'm very much interested in filing a formal complaint with the CIS and Ombudsman. I'm not against genuine candidates getting their GC through MNC executive category, but would like to stop this malpractice.

As some of you know, I have been working with news media, government leaders, and immigration lawyers over the past year because of the stimulus debacle. As a result, I have developed some strong contacts in government. I will be meeting some congressional immigration staffers in the next few days and I have developed a list of issues to discuss. If you want to post your own issues, feel free to do so in this thread and I will add them to the list. These are the same people who helped get the last stimulus bill changed in our favor, so they do have influence.
PLEASE be brief - bullet points would be good.
Also links to articles to support your concerns are welcome. I will put together a package to hand out at the meeting.

I understand that. However, apart from canvassing the support for CIR by writing to senators, lawmakers, in what capacity can IV influence USCIS to take up EB-3 cause?

I have a question regarding an appeal I did a year ago for a rejected LC.
I have an approved LC and I-140 on an entry level position (EB3) with my company. after I got a promotion to a senior position that requires a masters degree but with a smilar job description but more senior and supervisory responsabilities with the same company. after promotion, I filed for a new LC (EB2) but it got rejected because DOL thinks it is the same position as the already approved LC. my company and I wrote a letter as an appeal on Sep 2006 within 30 days from rejection of LC to BALCA explaining that new position requires a masters degree and it is a senior position with more supervisory duties. as of today, almost a year later, we haven't heard anything regarding DOL (BALCA) decision on my appeal. is anybody in the same situation?? what should I do next?? also I read somewhere that DOl might revoke the already approved LC EB3 after I filed a second LC for EB2 with the same employer. can DOL revoke the first LC EB3 after I have an approved I-140?? please help. The reciprocity treaty between US and other countries donoring H1 immigrants is very important and sensitive. This could be a very powerful leverage for the US law-makers to make them think again about the legal immigration...
It worth the IV forum to start digging in this direction. Together with the exposure to the media this would be the remedy of our problems. The rest is a waste of time.

I am not sure how far it is true, but this is the content of the email I got from my attorney when I pressed him to file at the earlierst.
"As soon as we have these forms back, all of the evidence for filing remaining from you, and I review the completed filing, we will file it. We appreciate your interest in filing on the first day the filing allows. We will endeavor to do that. I should point out that the current bulletin allows for filings throughout July. It is possible that the filings could be discontinued later in July. We are in touch with officials in Washington about this issue and will file your application in a timely fashion for obtaining the benefit when the filing is properly prepared."

I called and enquired abt my case. I told I was beyond normal processing time. They gave me some service request no... and told me I will receive an email within 30 days. What does this mean!

With this attitude and arrogance, I rarely think there would be motivation for anyone to do anything for IV.
I started discussion by asking , how can IV convince me that my donation is going to help, I got shot down by ARROGANT ******** and got all reds as if I care. I was planning on a charity/donation drive of my own to get some money for IV.
Know lot of consultants, who really dont know what to do with their miles with every one a executive airline status.
Already have 10+ people pledging Poker tournament from my poker group with their miles for Airlines and hotels. We are talking of a Million AA miles.
Indian restaurants(s) having a Immigration week where a dollar of each bill be given to IV.
I was even thinking of standing at Indian stores in Dallas to ask people to consider for IV cause, as long as I believed and hence was asking.
I was just getting started with so many ideas for my free time.
Good luck in what ever you do guys. Note that GC is not everything and note that I am still on extended H1, family on H1 and EAD never helped me. so assumption that EAD helped my life is baseless. All these hypocrites are long gone from IV once they get GC. All we get is response that Mr X or Y , even after getting GC, is working fro cause. How can I believe.

Agreed, It is very unfortunate for people stuck in backlogs and I feel your pain... But would you rather have seen USCIS waste over 40000 visas by the end of the year without any PD movement (as reported by some on this forum)? We would have had another thread here blasting the inefficiency and unfairness of USCIS.
Bottomline, I would not like to work in USCIS right now.. They are basically damned if they do, damned if they dont. That said, I do hope that BECs get their act together like USCIS is trying to and get everyones labor cleared by the deadline before the next retrogression hits.
I mean even if some of guys had their PD current, USCIS did not approve the I-485. They said that all the I-485's are preadjudicated but did we see flood of approvals....? NO...
