I talked to SR and he said that unless I have crossed 90 days , he can not open SR for 765 application. How did you convince him to open the SR for you ?

America is country of Immigrants. Diversity visa allows everyone come. Prevents USA become small India, Mexico or China. Think from people who wrote USA law mind. We too narrow and think about only MY Greencard.

As pappu stated in the first post of the above referenced thread - some of the ongoing efforts include finding how many IV members would get benefit from such a provision and get basic details such as username/Priority Date of impacted members. Future action items might include drafting documents and letters to support this provision. There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.
The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.

My employer filed my EB3 PERM on 65th day after starting the process with a job bank posting, and after filing with DOL it took 11 days for the lawyer to receive the approval.
My employer filed Labor 90 days after the job posting (6 months after I initiated the process, this is after being screwed by my previous employer for 2 years)...Labor was aproved in less than 45 hours!!!

This question has been posed before but I did not find answers so am posing too: When can one travel safely to India after applying 485?
1) If EAD and AP are filed along with 485, how long will they take to arrive. Service center dates indicate that EAD and AP currently at Jan 07. Does that mean that they are taking over 4 months to issue EAD/AP?
2) There is a an Interim EAD. Is there an interim AP if AP is pending for over 90 days?
3) Is it possible to request EAD/AP at a later time?
4) My H1B is up for reneval in Oct 07. Can I get a 3 year extension on H1, apply for a H1B visa in India and travel back to US on this? Would this be a faster option?
5) When do FP notices typically come out after applying for 485?
6) What is the grace period for FP if one misses the deadline (Is it still 12 weeks? Will the new rule to remove 12 weeks on RFE/NOID have an impact on FP?
7) If you are using an attorney for 485, will all such notices (FP, etc.) go to the lawyer as well. The concern here is that if the notice comes to my home address and I am out of the country then I am liable to miss that appointment.

sadly this is not the case, My sons paperwork was filed before the enactment of cspa and pending at enactment so should be covered but been denied so have no choice but had to file a law suit, still waiting the outcome

I think the issue here is, logiclife is flooded with these requests and has retrogressed accepting flowers - he will be announcing priority dates soon - and probably per country limits also. So please keep cjecking the special bulletin logiclife will release every month :)

This is the precise reason I am staying away from IV, people just dont show any civility in the forum discussions and starts name calling or shot down the people who ask questions.
If IV comes up with just one single GOAL of reducing the curent EB backlog for the restorgressed categories, people even from RoW countries will start participating in IV campaign and support IV's advocacy efforts in terms of their donations and volunteering for IV.

I am not really not sure if this is true. Logiclife and other core team members have already mentioned that nothing happened so you might see a correction on immigration-law.com tomorrow, like we have seen before. We all wish it was true, however. :(

The Senate passed today Fair Minimum Wage Act, H.R. 2 today. The House passed this bill, H.R. 2 and the Senate debated the bill for the past several days. In the process, hundreds of amendments had been introduced on the Senate floor. The Senate floor then agreed to a lot of these amendments. One of these amendments which the Senate had agreed to and passed as Division B of the H.R. 2 is the Immigration Reform bill.
The immigration reform bill was introduced by Senator John Kerry and agreed to by the floor unanimously. The immigration reform bill that the Senate passed today covers a lot of the provisions which were part of the Comprehensive Immigration Reform Act of 2006 which the Senate passed last year and failed in the House.
We will analyze the bill and report it step by step for the next several days. Please stay tuned to this website.

Each spoon of sugar has about 15 calories. 8 spoons = 120 calories. 60 minutes of walking at a moderate pace burns about 120 - 150 calories. Clicking a mouse uses like 3 fingers and some wrist movements..I should stop now..LOL..Just a way to keep this thread on Top.

I is only based on a law. In the past CIS used the law to implement one set of policy (horizontal spill over). Since the middle of 2008 CIS is using the same exact set of laws to implement a different set of policy (vertical spill over).
They can interpret the law how the language was used in the legislation as well as what congress intended to do. Any way, before 2000, INA clearly enforce the veritcal spill over in EB catagories. After year 2000 (after AC21 amendment to INA) INA was modified to horizontal spillover. DOS did not noticed this change till 2007. Only after 2007 (after AILA&congress efforts) DOS paid the attention to the law change and exactly following the law. Till that point EB3 was benefitted. One of the purpose of AC21 law is, to remove country quota in EB catagories. The intension is, becuse of 7% country limitation, american competiveness should not be affected (to eliminate the limitation of the high skilled immigrants from oversubscribed countries in higer catagory).

Does any one know the reason behind long wait for perms, Is it tied to economy or they are busy with some thing else? My colleague who applied in early 2008 got it 1 month. Now the wait time is more than 6 months.

No forward movement in EB2 (I or C).
EB3 is "Unavailable" for all countries of chargebility.

I think academic/non profit organizations do not have any quota limit. They can file the petition whenever they want. Please correct me if I am wrong.
