I think the PIO Card usually comes from Delhi. But, if you go in person, you could probably get a visa on the same day. You can get the PIO Card once you return from your trip

It is good to see the combined Immigration community efforts are bringing results. However, it appears that no attention is being paid to raise the issue of children ageing out because of visa retrogression and delay in labor clearance. The Child Status Protection Act(CSPA) passed in the year 2002 hardly provides any relief to I-140 based immigration petitions. While for I-130 (for US Citizens) applicants the date of child is frozen on the date of submission of I-130 form it-self, but for employment based immigrant applicants this Act provides a complicated way to calculate the childs age and it just provides relief for any processing delays in 1-140 clearance only. It just ignores the fact that we have years of retrogression for employment-based category. At the time when this act was passed there was no retrogression in employment-based category and lawmakers perhaps never thought of hardship, which children and families may face because of the retrogression.
We need to raise our voice on this issue too. My son is going to miss out the chance of getting his green card just because his age works out as per formula given in CSPA Act to be 21 years and 12 days because of 12 days my family may be penalized to be separated from our child whereas no one is going to consider 3 years delay in labor case in my case and then another 13 months we have to wait for filing 1485 after approval of I-140. Mine case was the most unfortunate in the sense that I got my I-140 approval in just 29 days whereas in all cases the normal time is 3-6 months. Had it taken 2 months, my son would have got the benefit under CSPA.
I hope some one from Immigration Voice leadership team will take a lead to highlight such issues also before the law makers.
Can any IV core member take this issue??. Thanks.

Hello,
My cousin H1-B has been selected in the lottery, so her H1-B is in process for this year, but her husband's H1-B was approved last year, so he is planning to get H1-B stamped and come here. If she waits for her H1-B to get approved and come then it will be sometime the end of this year. Is it possible that she can come here on H-4 visa while her H1-B is still in process? Need urgent help on this. She has never been to US.

Retrogression in Various Steps of the GC process
While January 2005 was the first time since July 2001 there was retrogression for the EB-3 category (01/01/02 for both China and India), the US continues to maintain protectionism through their immigration system.
Retrogression in Labor Certification: Between 2002 and 2005, there was severe retrogression as far as labor certifications were concerned. Then came the PERM in March 2005 and for a couple of years, they boasted labor certification with 3 to 6 months time. Of late I think it is taking more than 6 months for LC approvals even through PERM.
Retrogression in I-140 Approvals: I do not remember when the USCIS suspended the premium processing for I-140 but even before they did that, they managed protectionism by delaying the approval of I-140. As per some one's posting, it is now taking 14 months for an I-140 approval.
Retrogression of I-485 Approvals: Post July 2007 VB, even a 1st year engineering student from India, studying the American immigration system, can tell you it could take years (not the current 6-9 months processing time) for approval of I-485s. The delay in approving an I-485 petition is not subject to the the July 2007 Visa Bulletin alone, it cannot also escape 'protectionism-tainted' FBI name check delay.
I may sound like quite a pessimist, but add to all this the possible denials for PLC (permanent labor certification), I-140, EAD, AP & I-485s.
My $0.02 - IE
Very Good Presentation.

^^^^ A very important day, where the house representation is expected to significantly change affecting the outcome of future bills, especially related to legal and illegal immigration.
Hope the changes today are for the better in general and will also help our situation.
Also I edited my first post in this thread with better statistics and more information I learn everyday, which will help newbies.

You are laying your own immaturity out there by rambling on and on about vague facts and statements only to make the same point again and again - that you think IV does not represent EB3. Why dont you state that one line and save us the trouble of reading your meaningless drivel??
yes, this rant is oft repeated by around 5-6 members who do NOT represent the thousands of EB folks (EB2 AND EB3) who are affected by this mess.
So before you start one of your long drawn essays again, step back and THINK (which you do not seem to be doing at all..or are not capable of doing) about whether you are contributing even one bit to solving the problem or trying to add to the problem. we can do a lot more if we spend less time trying to drill sense into wayward people like you.
Think about -
1) how many lawmakers you have met till date to resolve the EB3 problem (which you accuse IV of not solving). Have you asked a lawmaker while per country limits cannot be removed....an act which will remove all EB3 backlog??
2) how many IV advocacy events have you attended?
Yes and you are showing your maturity by talking about what i write as a long essay and garbage. Why are EB2 guys scared to have a dicsussion. Is it because you donot have any talking points and are talking vaguly yourselves
BTW the reason i write so detailed is because i believe i am respecting you by replying in detail to your points. I was under the impression that we were having a discussion, but sadly i am having a disucssion and you are ranting and raving.

On a related note, free riders may not be checking this forum. The title says that this is of no interest to them.
I agree, titles like "H4 to H1", "Changing Employers", "Urgent question" etc. etc. will obviously be visited more.
May be a gentle reminder about contributions in other topics would help.
How sad it is that we don't get support from our own.

Hi
I am living in Toronto/Canada.My Labor and I-140 is approved. My PD is current, so I can file I-485.I would like to know that, how long will take time to I come to USA and what else needs to be done.
thank you
You MUST be physically present in US when you apply 485, otherwise CP is the other option.

Mine EAD had status change on July 14th from 'pending' to 'card production ordered'. So when will they print my EAD??? my EAD will expire on August 16th. I am working on EAD.
E-filed - May 8th
card production ordered - july 14th
Mine is approved on June25th. No card till now. I talked to IO and he said that he sees it in printing queue( Not yet Printed ). They printed approvals from June 19th on July 14th. So I am hoping they print mine this week.

I guess we have enough people convinced and for those short sighted ones will have an option whether they want to get naturalized or live on their dear GCs so by that time if they educate themselves they will be convinced too.
Now what are the next steps in chanelling this effort through IV Core?
IV Core, please go through this thread and consolidate all the valid and genuine points and consider this for the phase 2 campaign...

I beg to differ from your point of view that approvals are on PD. If you take a good look at the PDs of approved cases posted here, you will there are many post July 04 (mostly in Oct and Dec 04) and we all know there are many before that.
They are clearly going by ND. I have seen 1/2 case approved that had ND after 8/30/07
High number of approvals over the first few days were expected. Centers review/preadjudicate cases based on 'real' receive dates (which are close to notice dates), as physical files are sorted in that sequence. That is happening. Sept VB was available couple of weeks ago, which prepared them to issue formal approvals as soon as September starts. USCIS SOP describes that once cases are preadjudicated they are shelved (wating for visa) in sequence of PD's. Therefore, most approvals are preadjudicated cases.
Congratulations to All who got approved. Best wishes to those still counting. If you ND is not too far from published dates (i.e. it is sometime in Aug/Sep/Oct 07), and your PD is high, there is very high chance of you getting a good news soon.

You are making the same error I made. This is part of SA180 and is contained on page 1113. On the other hand SA 187 is mentioned on page 1121 and that is what got passed.
Go looking for what happened to SA180 and you may get an answer to what happened to what you quote below. Right now I cannot find what happened to SA180.
TITLE VI--FAMILY UNITY AND BACKLOG REDUCTION

Sec..1603..Allocation of immigrant visas.
Sec..1604..Relief for children and widows.
Sec..1605..Amending the affidavit of support requirements.
Sec..1606..Discretionary authority.
Sec..1607..Family unity.

Years we have been told priority date establishes your place in the queue.
We have spurned job offers and declined the new PERM process to hold on to the priority dates.
Many are still awaiting labor certifications from the backlog elimination centers. Out comes USCIS and says everyone with a LC can file I140 & I485.
People still waiting for LC with priority dates in 2003-2004 are seeing applicants who have priority dates as late as 2007 but with approved LCs through PERM walk through to I485.
Net result, USCIS is going to be flooded with applicants enough to retrogress the priority dates 3-4 years back as early as september. (Everybody with a LC will be able to file for I485 in July). So applicants with priority dates of 2007 are going to get EAD and GC, while LC backlogged 2003 applicants to have to wait for another 3-4 years before they can even file I485.
Aint fair. Aint fair at all. How can this be. How can rules be changed in the middle of the game.
I truely feel your pain but I don't quite understand what you say about declining PERM to hold your place in the line. As far as I know and correct me if I am wrong, doesn't PERM has the option of porting the PD from an existing and pending labor petition?
Again please don't misunderstand me. I am not trying to lecture you. But please look in to that option.

On the same note guys..Nothing changes after GC.. I have always lived with this thought..If i want to go live back in India, I dont need a GC, If i decide to stay here in the US, It does not matter when GC comes..as long as u have legal status that you can maintain ( I know may not be for everybody ..esp who are in the clutches of the consultants)...most of you guys can change to job of your choice and maintain status..Without a GC, i have done everything you can do with one..( Job change, House buying , what else?)...So while i know it is a comforting feeling to have a GC, dont let that drive you crazy...the system is as fair or as unfair as it can be, it is how u look at it..Just chill ..good things will happen. Wishing you all the very best

I have renewed my passport and my wife's a couple of times in through Houston (That tell you how long I have been in the US without a GC). It typically takes them 3-4 weeks (Rush service is also offered). You can opt to pick up the passport in person as well. If you have been waiting very long for your new passport, call them up and speak with them. I have noticed that it help greatly if you speak with them in Hindi instead of English. Goodluck.
