    From reading all the testimonies , I didnot see any argument of unfairness to employment based immigrants.
    Senate was interested in hearing the plight of a gay american citizen who could not live with his gay partner because his student visa was refused on reentry from Brazil and this gentleman couldnot sponsor him as a family member because the immigration act doesnt recognize gay partners as family members.
    I suppose being a gay is going to be a much faster way to becoming a legal permanet resident rather than being a highly skilled indian immigrant.

    last time i posted this idea everyone ridiculed.

    Well we desis can only follow the lead of firingis.. so firingis say that who the f*** asked you to come here in the first place and we understand their logic and tell ourselves who the f*** asked us to be here in the first place .. so we are to blame ourselves for everything and take the crap anyway..

    But that is not the point.

    The point is that me and my company and you and your organisation have paid a service fee with a reasonable expectation of service. reasonable expectation of service is subject to interpretetion based on common sense and no f**king common sense says that waiting 10 years for GC is reasonable .. unless your common sense has been replaced by self disrepecting logic ....

    Another important question is: Will USCIS allow AC21 without an approved EAD?
    When you send all the relevant documents to invoke AC21, there is every possibility for the officer to check whether you have an approved EAD or not. In that case there might be a problem. I may not be correct. But to switch to a new employer, you definitely need a EAD card. I switched employers. My new employer asked for work permit(EAD in this case)

    Note : Please check with your attorney, I'm just one like you and this is my experience

    If my priority date is retrogressed at the time of processing my EAD and AP, will USCIS keep the EAD and AP on hold? Or will they process EAD and AP and hold the I485?


    They will send your application back to you.Maybe some experts can opine on this

    If there is unity, and all of us walk out with all our money, this would definitely get the attention of the lawmakers.

    I suggested the same action last year. Right now, waiting for 485 (EB 2 LC took close to 6 years) - but I feel if 20-30K of us left (and take our money with us too, don't leave it here to work for this country) because we are being screwed by the stupid immigration laws, that will have a bigger impact in changing the laws than any lobbying effort possibly would.

    We booked a brand new house recently...after switching from consulting job to permanent job..I am on EAD

    GC wait is endless ...kids are growing and don't want to raise them in rented apartments....paid 5% downpayment to have minimum risk...we procured couple of properties in India from our previous savings to fall back in case any unwanted situation in US

    Thanks Superdoc for your response. Can i continue working on EAD while my 485 is pending ?

    This is what Murthy forum says. "Attorney Murthy : Well, if the I-485 is reopened and the USCIS agrees that it was wrongfully denied, then one should be fine. On the other hand, if the I-485 denial is reaffirmed, then the USCIS could take the position that the EAD was not valid for employment authorization and the person worked without valid documents and, therefore, violated status and could be subject to removal. If one has an H1B petition approval, then there is some possible backup H1B status, in case the I-485 denial is reaffirmed. It also can depend upon the language in the I-485 denial, and whether there is a specific revocation of the EAD in the denial."

    In my notice it doesn't mention anything about EAD.

    But look at the case before this bill i.e now
    With 140,000 we have more candidates in the backlog and many more joining through Perm process.
    If CIR is passed, many in the backlog will move to new merit system because their labor is still pending and no new GC application after May 21st 2007 also.
    So, you have lot less people picthcing against 10% of 90,000 visas vs the case now where there are lot more people for 7% of 140K.

    I still don't get why it is bad for everybody?
    It is definitely little better for those who can use older GC process/system with 10% of 90K visa numbers.

    Also, i bet there will be another amendment to add more to 90K for clearing the backlog much faster.

    i guess the people who are on the fence, thinking, if US doesnt work out i can easily go back to my home country.

    (non indians please ignore this part - due apologies)

    - desis who spent the formative years of their life here doing -- desigiri-- saved some money to go back, only to find that the money saved is not worth that much anymore.;)

    That is life...if you factor in the inflation rate to your 20.8 lakhs...you will realise that it would have been better if you had at least 'enjoyed' your stay here instead of trying to increase the national savings rate.

    Maybe now spending that $20 on IV might not sound that bad...after all, these days, its not much in rupees too...2wadas and one chai, thats about it, my friends :mad:

    I think they had given a waiver till August 21 or so for the July fiasco filers.

    Do you think I still not have to pay or should I pay the fee ?

    Oh ya I remember that.
    I recommend you talk to some lawyer or call USCIS.
    USCIS is helpful.
    My take on it is this : you have to PAY $340.
    A lawyer will always say "DO AS PER INSTRUCTIONS".
    But this case although unique, you still belonged to the pre-aug filers, even though there was a waiver (since u were applying based on PD which was for july month).
    I remember that during that time USCIS has instructed everyone to add some kind of bright color sheet / paper on top of your application to state clearly that you belong to that group of pre-aug filing people and that you are filing using the old fee structure. that way you are clearly telling them "dont reject me directly because of incorrect fees".
    Again although this seems very straightforward to me, that you HAVE TO pay $340, I still recommend you research more/talk to lawyer/USCIS.

    Absolutely wrong. Lot of misinformation here. You can very well apply for OCI for your child even if both of you are Indian citizens and the 4 steps mentioned above are just wrong. I would prefer OCI over PIO as mentioned in the other reply too, on PIO your child will have to register with the police station evry six months if stay is longer. OCI is valid forever while PIO is valid for 10 (or 5) years and OCI means you have all the rights but can't fight elections and vote.

    In 2005 my first kid got an OCI as the rules were diiferent then but in 2009 the current rule is that one parent MUST be a US citizen and I had to take a PIO for my second kid in 2009.


    Following is from the FAQ`s of Indian consulate at SFO

    6. Are minor children whose both parents are Indian citizens eligible for OCI?
    No.

    Life is what you make it. No one force anyone to come to this country on VISA and work and be In GC line. Things happen in life. The way you are talking is as if whole world will collapse if you don’t get green card. No one would die because of that. Grow up and move on in life. This is just a minor obstacle in life. Smart intelligent people can make money and have a good life any where in the world. Probably you would face lot more challenge in life than this green card issue, which I am sure you will give your best to overcome. Don’t make this GC a big deal in your life. :)

    I mean the way we talk on these forums are as if all our careers along with our family life will be finished before we reach 30-32 if we don’t get green card. Come on man, so many people faced so many disasters from WW1-2 to flood to hurricanes where they lost everything and still moved on to do great things in life and here we are depressed because of this GC?



    Its very interesting to read about people’s different perspective about same thing we are all after.. lets ask ourselves.. honestly why we do want GC and I am sure we all would have multiple reasons for this in our subconscious but would not like to bring it to forefront because it would only undermine our own ability to fight it or make life more stressful.. but end of the day we all want this card.. for me I want it mainly for security and peace of mind…lets look at the different situations.. these might be extreme but we all might have thought about these situations atleast at some point in the recent past… .. and especially the people in the seventh year

    1. You are in your seventh year… and you loose you job….what is the first thought that comes to your mind.. I got to pack and leave .. pack your home of seven years and all your possessions you collected, in two suitcases of 50lbs each and leave…forget the Flat Screen TV,, forget all the electronics and the two cars you love ... just list them in craigslist …

    2. You have home which you bought with so much pride…what do you do? ..List it.. make a desperate sale in this falling market.. loose a ton of money and leave…and don't even talk about all the silk plants..floor lamps.. the furnishing,, they are for the yard sale on the Saturday..

    3. You have child whom you love and have plans for them.. love the school.. are an active member in the PTA … all of sudden what you do.. pull them out of school, move them from the only culture and the country they have known the only President they know is Bush and the only national anthem they have learnt is "The Star-Spangled Banner"…to another place where they don’t even understand the language forget the culture, national anthem etc..

    4. Think about your spouse.. they have adopted themselves to this lifestyle.. probably felt lonely when you moved here 7 years but now like it.. its time for them to move back…why because your don’t have a GC

    5. Forget the Golf and Tennis you enjoy so much here …it was all a very good dream..

    1. You are educated.. have a masters, have a professional degree.. but have been in the same position and department because of your long wait for GC, what happens… the fresh college graduate or the dumb blond who joined two years back and whom you taught how to log into the network is now your peer and you are still on the same desk doing the same job getting the 2% raise and working even more hard..so that you can keep you job..with a new dumb boss.. who thinks you are so dumb that you have been in the same job for so long time..
    2. All your batchmates are doing great..some of them are now sweating to be VP’s having risen by changing jobs …. You are still years away from that situation.. what do you do.. stop attending alumni meets and envy the mails in your yahoo groups from people..
    3. Seven years in US.. you have made your professional contacts.. and have a social network.. in which you invested your time and effort.. loose your job in the seventh year.. and all these contacts are nothing but an occasional international long distance call in future..

    Last but not the least… flight back home to your country is not going to be as smooth as the flight to US was seven years back.. back home look for a job..learn the whole new professional culture …and then set up a new home,,new school for kids….why because we could not get a GC.. which was not in our control.. and because some stupid insane guy sitting in cave 10K miles away decided to terrorize the people in America in 2001.. and make life difficult for all the people..including people in H1...

    We might all go back to our home country one day.. but the ride back home would be much more pleasant and happier of a choice we made and not because we did not get a GC…

    That is what employers want. To hold you till you have no more juice left.
    When in your prime you have given all you got for 5-8 years who cares about you after that, not the employers not the system.


    It is all part of the plan. When u are on H1, you have to be 200% productive. That benefits the economy. All and sundry here know the game. So they like you to be the way you are for a long long time.
    Contribute to Social security with no benefits, pay taxes, buy cars
    etc and boost the economy.


    After 5-8 years if you still have the energy left to wait, then sure, you stand a chance after perhaps everyone else gets a GC.

    USCIS Ombudsman has released the 2007 Annual Report to Congress at link below. It is an interesting read. I am still reading it. At page 31, the question is posed:

    �Exactly how many employment-based green card applications does the agency have pending?� USCIS still cannot answer that question today with certainty."

    Also, per the backlog redifinition, the USCIS has about 1.2 million applications (as of March 2007) that it considers active. However, it does not count an additional 1.3 million applications in the backlog that are considered "unripe" cases by the USCIS.

    I request the moderators to make this a sticky and if possible put a link on the homepage.

    often times i have noticed that the blissfully ignorant GC applicants come better off than rest of us- who act like chicken with the head cut off after every bad news!!! may be they dont worry too much and look at it from a whole another perspective...who knows...i wish i could be one of those, but i am too far in the game...damage is already done...:D

    No offense to anybody from Canada. I am simply trying to illustrate the rationale about the GREATEST IDEA OF THE CENTURY, THE SILVER BULLET, THE FINAL FRONTIER TO ALL IMMIGRATION PROBLEMS - "point based system"!!!!! Oh really???

    As such, Canada does not really have as many jobs as in US. Offcourse it is a fact that PhD and Doctors drive cabs in Canada because they can't find jobs, but someone who is not a US citizen finds a good job in USA because it is simply the land of opportunities.

    I am not saying points system is the best, but opportunities play an important role and thats why US has so many jobs compared to other countries, though so many jobs are outsourced. There is always growing demand and the economy is huge and accomodative.

    Canada on the other hand is still slow to add jobs it the pace America does because of the lack of infrastructure (As I have not been in Canada, I don't have much information on how things work, but I know for sure that getting jobs is very difficult)

    We must have a seperate thread on merits and demerits of points based system over the existing system and the issues being faced in countries like Canada etc..
