When my lawyer applied for my H1B extension she forgot to apply for my wife's H4 extension (Form I 539). Now after about year and half when we are preparing to file for our 485 status adjustment we she found out that she forgot to apply for that. So she is now filing the Form I 539 with an explaination. So that means my wife has been out of status for almost more than a year now unknowingly. How much of a chance does she have to have her form I 539 approved now? Any response would be very much appreciated.

100% agree with confidence. My prediction based on statistical analysis (That is the only thing I have regulary done since 1999 and still doing .. no end to this tunnel...:eek:) is as under. Yopu would see +- 2 months here and there in every bulletin.

I just received form ETA-9035E pdf from my employer. The email says you should keep this for your record. At the bottom of all the pages in the pdf it says "FORM CERTIFIED". And also there is a section name "US Government Agency Use Only" which is signed by chief of Division of Foreign Labor Certification.
Do you know what does this means? My employer is not giving me clear answer.

Anything with the legislative effort aka unused visa recapture will not happen in this political environment.
My only question to the EB3I is,
Do you want to wait until the visa recapture, when ever it happens or will it ever?. More-over this has been taken up by many people in this forum and fizzled. To add more, do you know what will happen when un-used visas are recaptured ? Will it benefit EB3I or will it be given to EB2 just like the spill over. Would you do something right now to atleast get some short term relief to EB3I ?
I am here in this thread to understand what we can do for EB3I immediately. I presented an option when somebody asked in this thread. If you want to take it or leave it, its up to you to decide.

I think your calculation is wrong. If there are 8742 applications then it should take less than 3 years not 5 years. In the 2nd case for 14583 applications the wait would be around 5 years instead of 10-12 years. This is due to the fact that every year around 3000 visas go to EB3 category. Though this is a long wait too so either way we need legislative fix for all the cases.
For EB3 Folks with PD's in early - 2003- there are close to 8742 applicants in front of you That is a wait of 5 more years.
For EB3 Folks with PD's in mid 2003 and later - There are 14583 applicants in line before you- That is a wait of 10-12 more years.
Now the only way forward will be to lobby with IV for a legislative fix. Apart from that there is just no option, the sooner people realise that and help IV with advocacy, the better results we will get.

He got GC in less than 1 year. Other 2 had real 7 years exp and got GC's in 8 months. All were working at Client's place and NOT intra company transfers.
I am not selfish. But I am sure this guy with 3 years exp may one day become a boss for any of us.

I don't see the point in dissuading people like this. This is an example of someone who was able to adjust an important appointment because he thought that it was equally important for him to be at the rally to show his support. Ofcourse there are some things that one cannot adjust, but is it really true of everyone?

If you are so sure that IV is taking your monies and screwing you, feel free to sue IV.
In this country, anybody can sue anybody over anything!
Now why would i sue IV. It is the organization which is making an effort. Sadly that effort is hurting EB3 folks. The whole idea is that we are a community and as a community we need to discuss all issues. Now when i talk about EB3 issues a EB2 volunteer (I commend you for doing what you are doing w.r.t. advocacy) asks me how many law makers did i meet. Now why would i meet a lawmaker as a representative of IV if i believe what IV articulates impacts EB3 adversly

3. For genuine Emergency Service such as death in the family please contact Vice Consul(Consular) at Tel. No. 713-626-3252 and or Emergency No. 713-478-6218.
4. Time taken to process :
(i) Indian passports, except reference cases i.e. Passport not issued by CGI Houston, are processed in 7 working days. Passports issued by other Passport Offices/Consulates/Embassies take upto 30 days.
(ii) PIO cards are processed in 30 days.

first the bottom line. a golden opportunity presented itself- we did not ask for it, the visa bulletin was made current out of the blue. we have grabbed that opportunity but that does not mean that this was the core goal of iv as an organization- those goals remain, our campaign continues, this little fire we have lit must grow to the point where all retrogression can be resolved. we have NOT forgotten that our friends in BEC are still stuck in the most unjust process.
next: please stop repeating this line that everything will be unavailable for years and people will cut the line. understand this: in oct the dates cannot be U. because there will be new numbers. therefore they will come up with a date- a retrogressed date allowing BEC people to file as soon as their LC is approved. just because a 06-07 applicant has a 485 in the system does not mean a Gc is imminent. GC can ONLY be alloted if the dates are current. The dates will be current for you long long long before anyone that's applied lately. If the dates remain U, USCIS cannot allot a single GC- and that cannot happen.
please be patient with those who are celebrating their stroke of luck. life is not fair and USCIS is weird anyway with it's FIFO. the ombudsman says they pick "low hanging fruit". we have much to fight for yet.

Summer of 2009 it took Houston CGI took about 6 weeks from time I sent to time I got my new passport. Given the speed with which you need your passport. Better go with Tatkal.
