I say my chance is 88.25% of getting approved :). Don't ask me how I got this number. All that I know is optimism is free
I checked with some folks who have got GCs in the past and they mentioned that FP (2nd time ) is not needed.....unlike the minds of USCIS one's FP doesn't change over his lifetime...that said..if you apply renew EAD u can get FP notice....
But if 15 month rule of FP is correct then very few will get approved as very few have received 2nd FP notice....so I am not sure what is good or bad...we need to know if the folks who had got FP notice had recently renewed their EADs or not.
I am current next month but I rate my odds as 2/98 meaning 2% chance of getting clear.....taking into account RD/ND/transfer/FP all vagaries into account....even Indian monsoon is more predictable.

kudos to what u accomplished in July 2007, but the reality is we haven't seen any major action after that. I guess its mostly frustration from ppl here, who think that the US housing/EB crisis can be pursued aggressively than expecting for CIR to happen.
thanks
I was once a non-believer but now I am a believer, not because of what core has done, but what this community of educated illiterates have not done. Every time someone has increased level of anxiety, that person comes to this forum, vent out on someone else, ask someone else that what have you been doing because I have not received my green card, and then after bickering in few posts, simply vanish in think air like a fart. The name of the game is, let someone else clean up the shit for me while I enjoy my pop-corn watching a movie with my family. But lets not stop blaming someone else for my own inaction for my green card. Demand answers right now because I had a sudden gust of enthusiasm to find out when I well get my green card. That's the way to go .... and the story goes on ....
.

Guys MY PD is feb 2008. I am recently watching vias bulletins. I am in EB2.
Based on my watching previous visa bulletions ( after sep 2008) I dont see that it makes major difference if you file in EB3 or EB2.
Both are backloged very much and sincearly I dont hope inspite on being in EB2, I will get EAD or GC till 2015.
What are your thoughts, is it worth filing in EB2?
Of course, it is worth it. Go with EB-2 and don't lose hope.
I ended-up in EB3 due to a mistake made by the lawyer back in 2001-2. Of course, we fired the lawyer, when we realized this. I wish I'd switched myself to EB-2 back then. I just didn't know of the possibility until recently, thanks to IV.

People with grown up kids, I guess would prefer Canada over India. There are many problems starting with the education system, reservations etc. For kids who had been studying here from KG through grade 8-9 it's difficult to get dragged in the rat race in India, especially for normal kids who don't belong to any reservation category.
Yes in Canada we know that finding a job is going to be difficult and we should brain-storm about how to tackle this problem?
What skillsets are in demand? Anybody has idea?
I also have a wild idea like US companies may look at Canada as a outsourcing destination if given very competitive package. One of the biggest advantage will be proximity to the US, so better control over quality etc. That may not turn into a big boom but is a possibility.
I think the said "outsourcing" is already happening to a limited degree .. in fact many IT jobs in Canada are nothing but canadian offices of US firms. But it is never going to reach the extent of India or China, mainly because the savings in terms of cost are not as big.
The biggest problem I find with the canadian job market is limited demand for highly specialized IT skills .. so finding any job will not be a problem; but finding one commensurate with your qualifications and experience will be hard.Secondly, there are fewer tech centers than the US .. so one cannot afford to be too fussy about location etc. As far as I know, only Toronto and surrounding areas in Ontario would qualify as a "tech hub" in the US sense.

What makes people think that USCIS has preadjudicated cases in the order of priority date. If they have preadjudicated cases from 2005,2006 and left the cases from 2003 -2004 then it is the same mess an d i can bet that knowing USCIS chance of this are very very high so even if your date gets current it is still luck whether you get GC ornot.
EB2 - I
PD: Jul 2004
While everything appears at USCIS to work randomly, but there is some order. They claim, and also follow, that they process application in order they receive. "Process" means to open a case the first time, and order they "receive" means when a center enters a case data in the system (this date is close to ND). Until this point, PD has no role to play. Described processes work well for non-retrogressed cases (for countries other than India, China, etc.). If a case is opened, and its all in order to clear except the visa availability, it is called preadjudication. Procedures described (see link below, although they may have changed since), state that once case is preadjudicated, they should be ordered in PD sequence for further work.
http://www.ilw.com/seminars/august2002_citation2b.pdf
Of course, if there is nothing preadjudicated, cases will go in sequence of "received date", which is close to ND, as PD is not even recorded in the system anywhere until a case file is opened.

Sledge_hammer, sanju and hpandey appear to be the only voices of reason here. Anything bad happens to anyone in this country who happens to be an immigrant and here come the conspiracy theorists. Don't be so paranoid, people. The burglars in this country believe in equal opportunity victimization. They rob everybody equally regardless of race or color.

After you wait for 7-8 years in your category for your visa your thougths will change. I have MS from an american university + work experience. Our lawyer decided to file EB3 in 2001, they convinced the company that EB3 is easier to get approved. i am still waiting for my GC, in the mean time i have gained a lot of experience, i am still an EB3 for USCIS. There are many in a similar position.
People talk about unethical practices etc. i feel that they ones who jumped the queue and used agressive lawyer already have their green cards. Most of my friends are already thinking about citizenship (and ROI after USC..that is a different forum :)).
Its people working in multinational companies who follow the law by the book are the ones who get screwed, its just my observation and opinion ..good or bad, i dont know...
When there is a overflow, I strongly feel that it should flow to all the categories and that is called equality. Some inefficient people in Decision making authority at USCIS framed a rule on visa overflow and they are following it. If the rule is not much logical/ethical to most of the people, then anyone can voice their rights against it.
Just for example, a team consists of one project manager(EB1), two tech leads(EB2) and 6 Developers(EB3). The demand is based on no. of vacancies exists on the market, that means a lot of EB3, less EB2 and few EB1.
As per this rule, USCIS is not actually feeding the hungry.
Regarding the country quota, US is not favoring/helping the foreign countries by giving GC to those people from them. So, it makes no sense at all when it comes to immigrants but I can understand the bureaucracy behind it.
If they are implementing the country limit then it should be like 0.00001% of that country's population, I feel.

All I can say is that everyone has their personal reasons for the decisions they make. This thread is information exchange thread for those who are looking to move to Canada. This isn't about why one should go one place vs another.
I welcome you to start another thread where ppl can debate whether they should move to India or consider moving elsewhere. In fact, I will be happy to discuss the options there. But I request ppl to not divert the focus of this thread.
Why don't you start a similar forum for "going back to India" ? I hate to burst your "bubble of hope" but Canadian population and job market is limited and the opportunities for professionals like us are limited. Why not consider going back to India and taking up some of the lucrative opportunities in middle management in the IT industry.
The Indian economy is booming and the salaries are excellent. You just need to make some adjustments with quality of life (pollution, traffic). Atleast its better than going to Canada, living in limbo while looking for suitable jobs for a long-time, sometimes even doing odd jobs just to make ends meet. I hate our Indian mentality that "every place in the world is better than our own country". Give me a break guys.
My plan of action is very clear: Go back to India and live there happily. If there are other opportunities in US then come back.
Cheers.

what a timeless masterpiece!!!
gives me goosebumps everytime i listen to this!!!
Couldnt agree with you more - absolute magic from ghalib
Lot many people had sung Ghalib before but nothing can be matched with voice of Jagjit Singh from TV serial Mirza Ghalib. The ghazals CD from that serial is my most adored collection, and I hope you are all referring to those Ghazals.
As Ashok said - Timeless Masterpiece.

You are talking about getting GC. My position is that I am just waiting it to be MARCH 2005 just to file for my 485. My job requires EB2 but attorney filed it in EB3 and now doesnt want to re-apply EB2. You all are better than my position. Been here for more than 8 years but still dont have EAD.

If I had my green card today, I would surely be making at least 15K more in my salary per annum repeat per annum.
If not all, many of you are in the similar situation.
My $200 contribution is just 1.33% of that lost opportunity per annum. If I take into consideration the 4 years of wait, it comes to 0.33%.
Almost anybody who is in US for 5 years on H1B can buy an nice little home. (Bay area is bit more cruel).
Last year I could have bought a home for say 500K. It would have surely appreciated by 50K. But because of the uncertainty of GC, I can not. That's a loss of opportunity of 50K.
My $200 contribution is just 0.4% of that another lost opportunity.
Now you know why I support this effort.
Most of you and your friends are in a situation similar as mine.
I urge you to become aware, make them aware and support this effort, which has a potential to minimize those lost financial opportunities, with your wallet.
Thanks,
nviren

No matter whether you are in EB2 or EB3, if you lose job then you are going back to stone age. So we are all in the same boat. The only hope is to fix the leak.
Hi,
I see your point. But, that's completely different scenario.....job loss would hit the same way to each and every category, I guess.
What we are talking here is to reduce the EB3I backlog atleast a little bit...may be a year or two behind EB2
Take me for example.I have been waiting for 6 years now...just because of a stupid decision I made at that time to go with EB3 instead of EB2. ( just FYI, like many other EB3 guys, I am very much eligible to apply in EB2 ) I am paying the price now::((( Ofcourse who would have dreamt in 2003 that it would be so bad....and it hurts to see people who have applied at later stages cruise by while we wait watchig the VISA bulletins month after month..and now when I want to port the econom is so bad...everyone is being audited....so dropped that idea as well
