Tina, my wife has the exact same issue. Pl advise. She is workng on H1 but getting delayed pay and paystubs and no W2 for 2006 since she dd not have SSN until feb 2007. To be safe, she wants to apply for H4 in Chennai although she still has valid H1. have 2 questions.'
1. can we fix a web appointment thru VFS for H4 visa stamping for her, even though she is on H1 right now and does not have H4 I797? I will add he as my dependent, since I am doing my H1 renewal as well and my case is strong
2. will they ask for her h1 paystubs and W2s if she is applying for H4 in chennai? Hopefully not. she has an expired H4 visa so she cannot re-enter on H4 visa.
3. also is it possible to travel from Atlanta or nearby to chennai without getting transit visa since we might not have time and aretravelling on expired visas. any short routes airlines you know?(singapore does not need transit visas?)even european cities that dont ask for transit visas will be fine.

there is no rule defining any length of period that you are required to stay with Gc employer but most people recommend 6 months mainly because of possible questions at citizenship interview.
If you have a very good reason to change jobs sooner than that then document it and be prepared to defend your actions if you plan to apply for citizenship.
I dont see any reason why this would affect spouse.

Hi Guys,
I am a July - 2007 filer and we got the FP request in July for me and my Spouse, I have not applied for any EAD or AP extensions recentlly, for a side note i have to travel out side US in July and my attorney requested for FP reschedule (which was actually scheduled in last week July) for atleast 6 to 8 weeks, but USCIS sent me the request with in a week with an FP date just 3 weeks apart from the original one..so i had to rush my things and had to come back to US to get the FP done..
I just called TSC and got a helpful IO. He explained me that the FPs for my case are expired as those were done in Nov 2007. He issued a request to send another FP notice, not sure what help it will do at this time. He did tell me that my case is preadjudicated but also mentioned that preadjudication means nothing more than that a legal clerk or junior IO has reviewed the file and everything is order, in other words according to him preadjudication does not mean approval without any review.

Created an SR request : ~ September 20, just got standard email saying Intial Review is still in progress.
We have an Info-pass appointment tomorrow. We chose the 45 day not response option. Not sure if that is ok when we get there.
Is there anything else I need to know before I meet a rep during the Infopass appointment.
We plan to take all relevant documents, along with a copy of email from a conference in Canada where my wife is invited.
Any input will be great.

Counterproductive? what are you talking about. If they want they can approve 25000 cases in one day. It is nothing to do with productivity. Its all plain politics.
I would let my application rot in USCIS hell than not applying. Regardless of what AILA says, I believe the verdict is going to be for all who is affected.
If they let us apply I-485 , we get EAD, hence the ability to change the employer after 6 months. Lot of us who work for Desi companies needs this.
I believe any efforts to make USICIS accept all applications can be couter productive. You can have some people getting stuck for sure for many years before they get their green cards. also since new fees kick in on July 30th, you will have to pay for the EAD,AP.
The law-suit can benefit only a few of us, so why is IV behind this.
Can the core members comment on this.

If my priority date is retrogressed at the time of processing my EAD and AP, will USCIS keep the EAD and AP on hold? Or will they process EAD and AP and hold the I485?

My 140 is still pending in NSC I have the option to quicky upgrade that to premium and then go for CP, what would be the course of action?
Also what are the wait times for CP in Mumbai India?

Keep in mind that you will not be able to change job even after applying for CP. This is what I think. I am sure others on the forum will share with you more about the difference between CP and AOS.

In Michigan they don't even look at your visa to renew your license.

I say my chance is 88.25% of getting approved :). Don't ask me how I got this number. All that I know is optimism is free
I checked with some folks who have got GCs in the past and they mentioned that FP (2nd time ) is not needed.....unlike the minds of USCIS one's FP doesn't change over his lifetime...that said..if you apply renew EAD u can get FP notice....
But if 15 month rule of FP is correct then very few will get approved as very few have received 2nd FP notice....so I am not sure what is good or bad...we need to know if the folks who had got FP notice had recently renewed their EADs or not.
I am current next month but I rate my odds as 2/98 meaning 2% chance of getting clear.....taking into account RD/ND/transfer/FP all vagaries into account....even Indian monsoon is more predictable.

Based on the posts here and elsewhere,even I had reached a conclusion that if your PD is not current and if you get married when its retrogressed,you will have to wait till it becomes current to add your spouse to your I-485.
But recently,I was talking to a friend.He was in exact same situation couple of years back and was thinking he cannot add his spouse.But when he contacted his attorney,he/she said there is nothing like that and he went ahead and added her to his 485 without issues. This is fact.As per his attorney any addition to primary application is allowed no matter PD is current or not. The thing is, it went off fine and he has not got his GC yet,but his wife's 485 is also filed.
Now I am not sure whom to believe.Is there any specfic USCIS faq or comments which clarifies this issue?

This rule of having at least one parent Indian citizen is in existence since atleast 2006. Just search around. I also know this as one of my close friend's OCI application was his kid was rejected based on this rule more than a couple of years ago !
You are correct. The rules must have changed recently. I wonder what made them make that change, Now children of US citizens (who were once Indian citizens) have an advantage over children who has both parents as Indian citizens. Weird.. isn't it?

We need to develop really intelligent strategies considering all the factors. Just throwing out ideas and organizing rallys may not be enough (although needed).
There are a lot of intelligent people on this forum. I think we need to work on our unity, commitment and implementing of strategies.
