The problems with the 350,000 GC-candidates are mainly two - BECs inefficiency and lack of enough visa numbers after LC approval. Fighting both issues should be the main goal of IV and have to be presented to the Congress. They are inter-related and should go together.
And, by the way, the problems of the legal immigrants should not be considered as "Indian/Chinese" only, this will not help much. These problems are common for the legal immigrants from many countries and this should be highlighted before the Congress. Do not forget that those congressmen are descendents of immigrants from all over the world, not from India and China only.

If you want OCI, there are a few hoops to jump through -
1. Apply for an Indian passport first.
2. Once the Indian passport is issued, apply for the US passport.
3. Return the Indian passport after the US passport is issued. The consulate should return the Indian passport back to you, but keep a photocopy in case they don't.
4. Now you can apply for OCI on the grounds that your son once held an Indian passport.

I think you should go to either Eatentown( Exit 105 on GSP). Before they started accepting all immigrant applications at all DMVs they used to ask every one to go there. I think you may be able to get a temporary extension for month or two.

I am following from the start of the original post. This was a post by a new member who appears to create rift among the EB2 or EB3. The reason I believe is he just want to incite in such a way that few other folks will respond and keep the thread floating. Later few other posts by himself were created with different ids. just observe the trend and you will notice it.
So folks dont respond any more and this rift creation will die down.
I hope the admins keep this thread open and not kill it. I am not sure what the intentions of the OP ( some of you claimed that he wants to create a rift ), but this is definitely a valid concern for all the EB3(I) guys. This is a natural reaction to the frustrations of EB3(I) guys just like the mass upheaval during the July 2007 VB fiasco. Since it was across the board, there were no differences. Now since this involves only EB3(I), there is not much support from IV or others. But in my opinion, this is as much unfair as the Julay VB fiasco.
Some of the EB2(I) guys are worried that their GC dreams would get delayed if there is any Admin fix for EB3(I). For all those individuals in EB2(I) who want to oppose any kind of admin fix for EB3(I), I just want you to think about it. Is it really fair? There are individuals in EB3(I) waiting since 2001 - a total of 8+ years. Don't get me wrong - but some of the EB2(I) guys who have applied as late as 2006 and 2007 are expecting/hoping to get their GC this year if there is a spillover. And I think these are the individuals ( not all of the EB2 guys though ) who are opposing any kind of admin fix ( please dont yell at me or curse me etc...if you are not one among those mentioned, then please dont worry..this is not about you::) Ofcourse i would like each one of us to get GC as soon as possible) to EB3(I).
And I dont see why there will be a rift between EB2 and EB3 if each of us follows net etiquette in positng responses. Let's do some constuctive brainstoming - without getting into perosnal attacks or getting too emotional. Let's do what is right and not what each one of us thinks is right. Then I guess there wont be any rifts. The only thing I am asking is to get EB3(I) to advnace a little bit. I am not asking for it be on par with EB2(I). I hope some of you see a point in my frustration::))

Thanks Kumar1 for letting us know the options. We both have valid EAD's in hand. I like to maintain the H1B status as I am the primary applicant for the GC.
As you said some of friends also mentioned the same about talking to lawyer. Only thing I expected in this time is peace of mind. This is the worst timing. We always wanted to welcome our baby with lots of joy and happiness. But this desi consultancy put me in this worst situation I never expected.

1) You have NO idea what it was like to find a lobbyist ready to work with us given a) We are dealing with a very sensitive issue b) We had only 10K in cash (5K raised by core members) and another 10K promised again by the core team. You knew my attorney tried me with DA question mode. I can only say it is very challenge. He will only ask Yes/No question, and interrupt you immediately if you try to explain something. I believe any man would be emotional in that scenario especially you really feel innocent.
Just an example, I have not said "push my wife to chair ", but in my statement, DA might ask "Does Police lie for his statement" I'd like to say "it is language misunderstanding". But DA would insist on Yes/No question and interrupt while you just open the mouth.

The recorded message at NVC says that on july 2nd they generated the fee bill and it was sent to my attorny. How long does it normally take to get the fee bill through. We are in the last week of jully now that 21days so far.

You are talking about taking an article and putting a perspective on it. Can you be more elaborate? If you are talking about articles being written on us, I believe there are not a lot.

By our perspective, what I meant was, if you see an article talking about common topics such American Compititiveness or Illegal immigration you can always send an e-mail to the reporter and talk about plight legal immigrants. In most cases you will see a response from the reporter, whether they publish it or not is generally a matter of who you represent and audicences to the cause and other issues . That's why I said if IV as an organisation sends an e-mail (it could be me or you but representing IV itself) there is a possiblity that you will be taken seriously. But repeating the same issue to the same reporter 100 times will not make it any important it might even have a deleterious effect. I have seen this method working in the past. If you disagree with my approach, let's agree to dissagree on our approaches.

the kid does not need a visa to enter India. Also, if you go on a visitor visa, then your stay is limited to 180 days at the max. On an PIO you can stay how ever long you wish to, but after 180 days, you need to register with the district police station to get a certificate of extension. this is usually valid for about 2 years. you can renew that every 2 years.
If you are on an OCI, then the above restriction on PIO does not apply. You have all the prvileges of an India citizen, except that you cannot vote and hold agricultural land.
I am not sure about sutdying at Indian citizen rate. You might have to pay the fees in USD, if i am not mistaken.

Sorry to hear that your 485 is denied....
My question to all the gurus here...I wonder what happens to EAD and AP after you appeal 485 denial?
I know that if your 485 gets denied then EAD and AP are void but lets say OP files 485 MTR(motion to reopen), does he have to reapply for EAD and AP or does that get reinstated based on the reciept he gets on 485 MTR?
Should the person stop working till he gets 485 MTR receipt or till he reapplies for new EAD and gets the approval?
Just curoius to know as these days denials seems to be the trend at USCIS and it would be helpful for all those who rely on EAD only and not sure what to do when there is a 485 denials for what ever reason.

Based on my reading I would like to provide few AP Renewal FACTS for the I-485 pending cases:
1) You need to submit 2 recent photos.
2) You do not need to submit $80 FP fee.
3) As per the text, you do not need to provide the letter justifying your request for AP, but I think it would not harm giving one. The reason does not have to be an emergent situation, it could simply be "Family Visit".
Please correct (or) add more.

think about it if it was just paying a cut to the management to get your person hired wont ur competitor do the same. i have seen ppl getting caught because the competitor came to know of this and got really pissed and spread it around and the manager got screwed. most of the big companies have very strict policy for even gifts acceptance and the kind of gifts and amounts of it. i m sure it still happens but it can not be as widespread as ppl think it would be. which vendor to use is determined by someone really high up. most companies also keep a track of how much the primary vendor is getting out of the deal and there is a cap on it. they ask for the legal contract to check what % primary vendor is keeping so primary vendor cant fool the company and underpay the consultant and keep a hefty chunk for themselves.

Going forward, EB3 would be in 3000 to 4000 range unless we come together as a force and act.
If it helps we can bring some good statistics experts on board to analyze the data we will have on our tracker and from USCIS. This will give us better estimates on movement of dates and how everything is currently being processed. let us know what you think or if you have any other ideas.
To do this it is important that we all input our data in IV tracker. Soon some more features will be added to the tracker and we will make it really robust easy to analyze. Could everyone help spread the word about the tracker so that everyone can come to IV and input their dates.

Going forward, EB3 would be in 3000 to 4000 range unless we come together as a force and act.
If it helps we can bring some good statistics experts on board to analyze the data we will have on our tracker and from USCIS. This will give us better estimates on movement of dates and how everything is currently being processed. let us know what you think or if you have any other ideas.
To do this it is important that we all input our data in IV tracker. Soon some more features will be added to the tracker and we will make it really robust easy to analyze. Could everyone help spread the word about the tracker so that everyone can come to IV and input their dates.
