hellomms Could you gather all such people who are facing this issue and want to join the effort to fix it, at a single place on an IV thread. Once we have a sizable number of people to take initiative this effort can be successful. It is difficult to divert attention and resources for a single person. Each immigration issue that our community faces is important to the person suffering from it. IV is a place where people can get together and do something about fixing it.

I'm really concerned now, as like many I've also shipped my paper work to the attorney, but have NO control on when they are going to file.
Anyway, we have to deal with all this.
That's bad...really really bad. We spend so much time and money on getting documents ready, medical records and all that. In the end, something like this happens and our bad luck continues to grow.

Please check with your immigration attroney as they know it better but here are few things i heard:
EAD+AP:
after 6 mths of I-485 filing, shifting jobs would be easy with EAD. costly because of yearly renewal but worth based on your situation. i prefer renewing this EAD+AP, even in H1 so that you can shift jobs when you got the oppurtunity because EAD takes 3-4 mths approval time and you can travel using AP like H1 when you dont have H1 stamping. Even if you have H1stamping but if you use EAD/AP while entering US then you are no longer in H1 unless you go out and come back with H1.
Cons: Fees is increased by 60-80% this yr for EAD+AP, so costly. Also if for any reason anyone's I-485 is denied then the period he/she used EAD will be out-of-status so applying I-485 again wont be easy with "out-of-status" but still possible, check with your attroney.
Note: But couple of my friends changed jobs using EAD+AP and got GC without any issue. so it depends case to case and your application and how USCIS process it.
H1:

We had our fp done on June 11th and there was a soft LUD on 07/22.
efiled on 05/21
EAD expires on 09/11
Hope we get our EAD approval soon.
I think they had a system glitch for some time. All the people who got an LUD on 7/22 essentially means that TSC had received the FP on that date.
I have an infopass on 14th I will see what information they will provide.

Thanks for your support Needhelp! I really hope you can come walk the 5k at the Houston event. As I said before, the 5K is a 45 min walk at a moderate pace. And like Santb1975 said, you can reach a goal of 5K in 6-8 weeks.

You are right. But many people came here at the middle of their carrier and they are struck here with their children education etc., They are bound to be here and there is no way. Further, in my country, there are still reservation policies in everything, which may prevent the kids in going in for the education line they like. I donot want to explain this more as I may be degrading my own mother country. In a nutshell, everyone who wish to be a citizen of this country will have lot of valid reasons for getting a citizenship in this country.
isn't the effect of reservation the same as the effect of affirmative action?
If your kid gets high scores in SAT but does not get into an ivy league college because your ethnicity is over-represented - but some other kid with much lower scores gets in (and its not a hypothetical scenario - happens every admission season and i sincerely hope does not happen to your loved ones).....where does that leave your logic??
i see your point that people do have their own reasons for desiring US citizenships - but sometimes its also important to take a step back and see what one is giving up!

The number of cases approved during 2002-2005 was at least 2-3 times what was being approved now(when recapture was in force)... improving efficiency will not give us any more visas... if there are 100k waiting for a GC they will still keep waiting no matter how efficient USCIS is. The fact of the matter is that they can only approve 3k per category per country. recaptured visas are free of country and category caps. It will not cause divisions or issues and will help unite everyone behind one cause. Other short term issues dont help(multiyear EADs or APs and such)...they just prolong the pain and drain money every year. The queue can only be reduced, by time or attrition or more output... we can all agree which is better.

Even if the recapture visa effort bears fruit and people will get interim benefit it will do nothing to improve the efficiency of processing cases at USCIS which I think is the root cause of this problem. You really cannot do anything in a short time except hoping for the best. Two things have to happen for getting a GC (i) Your file should be or should already have been reviewed, and if all good to go, preadjudicated. That depends on your receive date by the Center processing your case (not RD on your receipt). This date is close to ND, and is often seen online as " your case was received on...". If this date is prior to published dates, your file definitely has been reviewed. Farther it is from the published date, lesser the chance, but approvals are indicating that if it is Aug, Sep, Oct 07 there is very good chance, though September has higher chance than October (ii) Your PD should be high enough. As per USCIS SOP preadjudicated files are piled in sequence of PD's.
Note that both conditions should be met before leftover visas exhuast. Third condition, which always plays significant role is, luck. This means, you hope that IO working on your case did not fall sick when he/she was about to look at your case, some document did not slip out of your file, person working on your case head proper eye glasses so as not to misread your PD as 2007, stack of preadjudicated cases did not fall down losing file sorting sequence, etc. etc.
