Snathan, Thanks for all your help. Its been 9 months that my application is in PERM process and nothing happened except an AUDIT. I want to get out of this mess. I want to do anything that i can do to get out of this mess soon.

Attorney can contact the DOL after 4 months of the audit reply. My reply was on March 11th. My attorney asked me to wait 2 more months for her to contact DOL.

Dont spend money unnecessarily for Tatkal...I applied of rmy passport renewal through post and it reached Houston on Febraury 22, 2010. I goy back my new and cancelled passports on March 4 through FEDEX. It was just 10 days....Also my friend got back in 10 days,,Unless, there is something pending from you, The consulate will not delay..there may be a few typical cases why the passport is delayed...
Also, I have the US address in my passport.

Guys,
I applied my EAD Renewal on April 5th. I have receipt with me but my EAD is not approved. Right now I don't have any other option other then EAD. I am little bit worried. Please let me if anyone on the same board. as well pls let me know and what are my options. EAD is going expire on end of July.

I had observed this last summer also that most of the CPO emails are received at night. In my opinion, it is probably due to the fact that they run these external communications as batch jobs at night, which is usually the case in any high volume corporate type IT systems.

I was wondering if any one in the core or other members think about the next step towards getting citizenship after passing the hurdles of getting the green card. If a person is here for 10 years and then get his green card (average period), then he need to wait for another 5 years to get the citizenship. 15 years for this process in a person's life is too much.
IV Core can push or lobby for a law which can make the person a US citizen, if he is living in US for 10 years legally without any issues and paying taxes for the entire period. It is just my idea.

I think current mad rush is because of following reasons.
1) Atlease 35K new H1s filed because of H4-H1 conversions. This is because of retrogression and H4s waited longtime to work and so they are desparate to work. We can eliminate this if we have I-485 filing provision without visa number availability provision of STRIVE act. These people deserve it until there no solutuon to Retrogression.
2) 70K visas are filed by Offshoring/Outsouring firms firms. This is where the actual problem is. They won't send all of them whom they file. They will unnecessarily waste all these H1s after getting approvals. I know so many visas are wasted by Satyem, Wipro, TCS, Infosys, Accenture and all other offershoring/outsourcing firms every year.
3) 15K-20K by US educated students. These are deserved to file.
4) 10K - New H1s for real projects needed by clients. These are also deserve to file for H1.
So, here the problem is Offshoring/Outsourcing firms who are abusing the law by filing and not sending all of them. I can definitely say 85% visas filed by these firms every year are wasted and they won't send all these employees whom they file. They are using this H1 as seat reservation in a bus/train. They only send very few and waste so many visas every year. In all these firms, i know so many employees are having H1 stamped and waiting to come here. But those companies selects very few and send them here. If at all we need any reform in H1B, then it is here by not allowing H1s from these Offshoring/Outsourcing firms. Then everybody will be happy. These firms can use only L1 for their company needs so that H1 won't be abused.
Also, first point, we can solve by passing the curent version of STRIVE.
So, we need to oppose this new H1B reform and make to sure that Congress passes STRIVE act provisions.

Second guess: You have a US degree or you are not working for a conslting firm.
Why do you think the spouses on H4 do no deserve H1? If they want to work, why do you think that they should not compete in the job market?
BTW, the companies you are cursing, TCS, Wipro, Satyam etc., it is possible that soon the H1s applied by these companies will be exempt from numercial limit. Yes, you heard me right. Here is a bill that would make companies providing scholarships to undergrad and grad programs to be exempt from H1 numerical count. This is not a joke, read for yourself: :p

I have a 11 pages PERM, where can I see in which category was certified. I don`t find any information. Please advice.
I think it is on Page 2 (Section H: Job opportunity information) --> Item # 4 = Education: minimum level required. If it is checked as "Masters" or "PHD" it is EB2, if not it is EB3.
This is my interpretation. It took my 3 months to get my job profile changed from Masters preffered to Masters Required. Hope this is what it is. I have been assured by my lawer it is EB2

I would like to add that GC give you freedom in terms of the Emplyment and Residing in US. But it also has very strict criteria how you live in this country. You are no free with getting GC. Giving some points
You need to carry your GC all times with you.
You can be deported out of country if you dont report you forget to report your address changes.
You can be deported out of country for very small crimes such as DWI, shplifting etc.
Most of the states and federal govt dont emplyee non-citizens.
Several goverment benefits are not available to non-citizens
You can not be out of country for more than 6 months. And also not multiple time.
You need to able to prove that you ahve permanent ties to this country all the time you travel outside. (irrespective of time frame)
I am sure some other members can add lot to these points.
So in nut shell GC and Citizenship are totally different.
GC will just give you freedom from your employer. I am sure in long run you will also realize that your that freedom does not help you too much. May be a little bit if you are with consultant or IT field.

You can see recent advance of OPT for STEM graduates as small justifification for such hope.
So lets continue this discussion, and comeup with good demand list and supporting justification , in terms of Citizenship benefit for highly skilled immigrants who get GC based on emplpoyment.

Agreed. But also please note that there is nothing called "GOOD FAITH". Just making a law is enough. It is US INS responsibility to ensure no one (mostly Indian IT companies and small companies in US operated from bedrooms, not basement or garage!! :) those created in garage are HP and GOOGLE) can exploit it. So blaming TCS and WIPRO and INFY and PATNI is not enough!! If we don't protect our house and thief exploits that to rob us that is our fault. This holds true for US INS too. And don't assume INS didn't know this. No exploitation is possible without Govt's active or passive approval. This is one big ecosystem and all have their share. That is how all businesses are operated across the world. Immigration is one of the biggest businesses here. And they want this chaos to exist for their interests.
I think it is the Big Fish , that needs to be blamed. With the Visa fee at the levels it is today , small time companies can't afford to apply thousands of visas just like that , where as your Infys and wipros coud do.

Has somebody ever wondered if EB limit is 140000 why the heck USCIS is allowed to accept millions of applications at the first place?

For EB3 (All countries) to see some light, the changes made recently to the allocation of excess visa, spill over and also to over subscribed countries need to be revisited. Not sure, what triggered USCIS / DOS to revise the interpretation after so many years. Did IV had any role on this, or not .. do not know.. I ask this as based on all forum updates, IV appears to have little success in the Admin Fix area. I have posted this so many times in various threads and did not get an answer, may be there is none. If the interpretation was somewhat like before, EB2 /3 both would have got the spillover... and all would have benefited in the order of PD. Now with the new interpretation. all excess / spillover visa just goes only to 2 countries (EB2 India / China). Looking at the latest numbers based on USCIS website, China has far less cases compared in India based on the cut-off date, which is good for India (EB2), as they now consume a big chunk of the numbers and rest are left out for now. I am not sure, what is opinion on this from folks from ROW (EB3) on this. Does IV has any comment on this... Having said this, I have nothing against Eb2 or EB2 India specific, and not getting into the argument whether or not EB2 need to given much preference.. (Well DOS allocated on 28.6% of total numbers to both this category). This is just my concern on the changes to interpretation for the visa spill over process.

My GC was approved today... I came to the US 10 years back. It's been such a long journey that it's tiring to even think about it. The backlog processing center, re-starting the GC process, Several H1b visa stamps, July fiasco rollercoster... At this point I think I am just tired - not happy, not sad...
